Motion carried - 3-0. <br /> ihr (Long, abstain) <br /> ROSS/KLOPP to rescind denial of June 25, 1998 and to grant <br /> permit with conditions for berm restoration as ordered by Zoning <br /> Department as a remedial action. <br /> Conditions: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances . <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . Permit valid July 24, 1998 with completion and <br /> certification deadline of August 7, 1998 <br /> Finding of Fact: <br /> 1) . Applicant, without required permits, moved substantial <br /> amounts of soil within 300 feet of Koshkonong Creek. <br /> 2) . Staff has asked Board to authorize restorative plan as <br /> submitted by David Cheney, Professional Engineer. <br /> 3) . Applicant had made several attempts to get permit to <br /> allow earth disturbing activity to remain as completed. <br /> 4) . Berm restoration incorporates a 12 inch drain tube to <br /> prevent water from ponding. <br /> Conclusion: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions .
