. <br /> Land VOL 16693 PAGE 66 <br /> Page 3 <br /> Lessee agrees to maintain the existing drainage ditch along <br /> the southerly 66 feet and along the westerly 66 feet of this <br /> parcel. <br /> Lessee agrees to hold Lessor harmless for acts committed on <br /> the above described land by Lessee or third parties and <br /> further agrees to defend Lessor from any lawsuit arising as a <br /> consequence of said acts. <br /> Lessor and lessee agree to cooperate to rezone Lot 1 and/or <br /> the property to RH-2, or such other zoning as the town and <br /> county boards may require in order to separate the property <br /> from other adjoining land presently owned by Leticia Smith, <br /> for the purpose of transferring ownership of the property to <br /> the owner of Lot 1. Lessor and lessee recognize that more <br /> than one rezoning attempt may be required. <br /> Lessee agrees to pay any fees or other expenses incidental to <br /> such rezoning, including any surveyor's fees if a survey is <br /> required for the rezoning. Lessee agrees to take all actions <br /> to facilitate the rezoning which can be taken without the <br /> participation of lessor. <br /> Lessor agrees to sign such petitions to the town and county <br /> boards as may be required to facilitate the rezoning, and to <br /> take other initiatives which may be required of her to <br /> facilitate the rezoning. <br /> If and when, during the term of this lease, the property is <br /> rezoned and/or separated from other adjoining land currently <br /> owned by Leticia Smith in a manner that will legally allow <br /> the transfer of ownership of the property to the owner of Lot <br /> 1, Lessor shall transfer ownership of the property to the <br /> owner of Lot 1, CSM 3556. The manner of conveyance shall be a <br /> quitclaim deed, with the restriction that the property shall <br /> not be used for the construction of a dwelling. Notwith- <br /> standing any other provision to the contrary, this lease <br /> shall terminate on the date of conveyance. <br /> Lessee may underlease or sublease the said premises or any <br /> part thereof, and may assign this lease with the consent of <br /> Lessor. Lessor will not unreasonably withhold such consent. <br /> Lessee agrees to quit and deliver up the above described land <br /> to Lessor or his attorney peaceably and quietly, at the end <br /> of the lease term. <br />
