My family and I have resided at our home for 9 years. Gary <br /> Miller of 4977 Hahn Road has applied for rezoning under Petition #5446 <br /> to allow for the construction of a second residence on his property. I <br /> was in attendance at the public hearing and listened to Mr. Miller's <br /> presentation, and also addressed the committee raising my own concerns <br /> about the lack of detail in Mr. Miller's proposal. The rebuttal <br /> comments made by the petitioner have raised some issues that you should <br /> be aware of. <br /> I was quite surprised at his reported commitment to the property. In <br /> the nine years we have lived in our home Mr. Miller's property has been <br /> for sale numerous times and for extended periods. His longtime dream of <br /> a retirement home on the property strikes me as being inconsistent with <br /> his actions. I strongly suspect that this property will be offered for <br /> sale again and will not be the idyllic retirement retreat portrayed at <br /> the hearing. <br /> The rezoning of property to residential should be done objectively and <br /> with attention to orderly planning, as the zoning and its subsequent <br /> impact may remain long after the individuals involved are gone. <br /> Review of the map detailing the area of proposed rezoning reveals a very <br /> unusual and odd shaped division if two homes were allowed on this <br /> parcel. I believe this would not be allowed in a newly developing <br /> subdivision. The era of ridgedly controlled unsewered subdivision is <br /> upon us. <br /> A discussion with the Town of Vienna Clerk indicates the Town has <br /> approved this request. A review of my copy of the Township's <br /> Subdivision and Land Use Plan indicates they had little choice. The <br /> property owner was entitled to a land division and was exempted from <br /> numerous restrictions because he owned the property before the plan went <br /> into effect. <br /> I would urge you to look closely at Petition 5446 and am confident you <br /> will find it not to be in the best interest of responsible zoning and <br /> deny the request. <br /> Thank you. <br /> Sin •re , <br /> Bob Merrill <br />
