A declaration shall be recorded with the Register of Deeds, said <br /> declaration shall pertain to the land included in the rezone area <br /> and any subsequent parcels which may be divided from the rezone <br /> area. Said declaration shall provide notice to an owner or owners <br /> of the land that: <br /> 1. The Deerfield Rod & Gun Club including a shooting range <br /> exists within 1/2 mile of the property, noise from the range <br /> will be noticeable. <br /> 2. This property is adjacent to agricultural use land. Owners <br /> of the property shall expect that there may be noise, dust, <br /> odors, etc. , as a result of normal agricultural activity. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land. Failure to record the restrictions <br /> will cause the rezone to be null and void. <br /> CONDITIONS <br /> 1. This amendment will become effective, if within 90 days of its approval <br /> by Dane County, a letter of credit is submitted to the Town of Deerfield <br /> to cover 30% of the estimated cost of improvements of a 400 foot segment <br /> of Pavlak Rd.
