Use of a facility by a scouting <br /> organization is a lawful use and some provision for it needs to be provided, I <br /> would consider the occasional overnight accommodation of a troop to be <br /> inherent to scouting. We currently require RE-1 Recreational zoning with a <br /> conditional use permit for a campground to accommodate a scout camp facility <br /> and office facilities are permitted in the B-1 and commercial districts. This <br /> is an around-about-way to permit the youth organizations but it is all we have. <br /> Overnight accommodation of scouts cannot be considered as a residential use <br /> because it does not fall within any of the definitions found in the zoning <br /> ordinance regarding residency e.g. , single, duplex or multifamiy residences, <br /> nursing home, lodging or boarding houses. We therefore have to look to uses <br /> which are similar in order to obtain guidance in making a determination. Uses <br /> which generate overnight accommodation are conference centers, day care <br /> centers, hotels and motels. All of these uses have one common requirement, a <br /> conditional use permit must be granted before they are permitted. The <br /> conditional use process allows a review of the potential impact of the use and <br /> input from adjacent property owners. <br /> My findings which are based on the above review of the zoning ordinance and <br /> zoning law are as follows: <br /> 1. Scouting is a lawful use and must be provided for within the zoning <br /> ordinance. <br /> 2. Occasional overnight accommodation of scouts is incidental to scouting <br /> and an integral part of said use which must be considered in some <br /> manner. <br />
