Application for Conditional Use Permit Dane County Application No. 906 N 1/2 SE 1/4 and NE 1/4 SW 1/4 Section 16 Town of Medina Payne & Dolan, Inc. has requested a Conditional Use Permit to erect and operate two drum asphalt plants in A-1 Ex. Agriculture District as provided for in SS 10.123(3) C. i, and K Dane County Zoning Ordinance. Governmental Use - Mineral Extraction Hot Mix Asphalt Plant. The proposed plants would produce hot-mix asphalt for W.D.O.T. Project No. 1068-00-77. Asphalt paving will begin April 1991 and will be completed in June 1991. The proposed plants would be erected on "Non-Conforming' land owned by Helen L. Hensen, 5643 Highway 73, Marshall WI 53559. A legal description of the property is: Town 8 North, Range 12 East, Town of Medina, Section 16. The north one-half of the southeast one-quarter, - and the northeast one-quarter of the southwest one-quarter. The proposed plants would be erected immediately east of the existing on-site quarry operated by Wingra Stone Co. The previously stated property owners have several concerns related to the granting of the Conditional Use Permit requested by Payne Dolan, Inc. They are: 1. Liquid heating fuel and asphalt mix base petroleum products spilled at the proposed plant site could enter the existing water table and pollute private drinking water wells. It is believed, the Volpe, Coughlin, and Siedschlag home foundations rest on the same bedrock formation as stone being removed from the existing quarry. These homes have experienced fracturing of their basement slabs from previous quarry blasting. We have assumed the existing bedrock has developed additional fissures from the same blasting. These fissures could direct surface spillage into the surrounding wells. The Wisconsin Department of Transportation Office of Environmental Analysis has stated the geological data for this area indicates the prevailing rock formations are relatively soft and subject to easy fracturing. Therefore, it is quite likely that past blasting has increased the quantity of fissures and the possibility for well pollution.
