Dane County Zoning and Natural Resources Standing Committee <br /> February 12, 1991 <br /> Page 2 <br /> 2. Stack emissions from the asphalt plants may present a health risk to area property <br /> owners, or may damage area crops or nearby wetlands. <br /> 3. The close proximity of the asphalt plants relative to the existing quarry blasting may <br /> increase the danger of fire and uncontrolled explosions. <br /> 4. The existing area fire departments may not have the appropriate equipment to handle the <br /> types of fires which could occur at the proposed plant, depending on the size of the on- <br /> site storage tanks. <br /> 5. Payne & Dolan, Inc. will be allowed to operate the plant for a longer time period than <br /> originally requested in their application if they obtain additional projects within the area. <br /> The mentioned property owners believe that final granting of this permit and plant operation <br /> should be contingent upon: <br /> 1. The potable asphalt plants will be removed from the site no later than September 1, 1991. <br /> 2. No asphalt or fuel must be stored, consumed or produced on this site, until Payne & <br /> Dolan, Inc. can produce documents from the Wisconsin DNR Air Management Group and <br /> Wisconsin DILHR Board of Petroleum Inspection and Fire Protection. That the proposed <br /> plant is in compliance with state code and regulations regarding: <br /> a. Air Pollution <br /> b. Diking and Spillage Containment of On-site Petroleum Materials <br /> c. Code Required Site Fire Protection <br /> 3. The Town of Medina, Dane County and Payne & Dolan, Inc. accept responsibility for any <br /> property damage or well water pollution. The property owners will have their water tested <br /> by the state hygiene laboratory prior to start of this construction, and within 1 year after <br /> the plant is removed from the site. <br /> We have spend weeks gathering information from state agencies and sources which may have <br /> jurisdiction relative to the proposed plant construction and code compliance. Much of the <br /> information is complicated and hard to understand. <br /> We believe it is the County's responsibility to protect the property owners and determine what <br /> specific codes and ordinances must be adhered to and Payne & Dolan, Inc. will be held liable <br /> for. <br /> The following is a list of information we have gathered and is enclosed for your review: <br /> Attachment 1: Property Owners letter of February 6, 1991 to Township of Medina <br /> Board (1 page). <br /> Attachment 2: Payne & Dolan, Inc. Conditional Use Permit Application and <br /> supplemental data (4 pages). <br />
