ee- <br /> µ <br /> The Agriculture, Environment & Zoning Committee of the Dane County Board, pursuant to its powers and after a public <br /> hearing, the applicant for Conditional Use Permit No. 904 or his agent being afforded and opportunity to pre- <br /> sent relevant facts supporting the application, and after hearing all persons opposing such application, does here- <br /> by make the following: <br /> FINDING OF FACT <br /> 1. That the establishment, maintenance, and operation of the proposed conditional use will not be detrimental to or en- <br /> danger the public health, safety, morals, comfort or general welfare. <br /> 2. That the uses, values and enjoyment of other property in the neighborhood for purposes already permitted will not be <br /> substantially impaired or diminished by the establishment, maintenance and operation of the proposed conditional use. <br /> 3. That the establishment of the proposed conditional use will not impede the normal and orderly development and im- <br /> provement of the surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other necessary site improvements will deer be made. <br /> 5. That adequate measures will.poik be taken to provide ingress and egress so designed as to minimize traffic congestion <br /> in the public streets. <br /> 6. That the proposed conditional use does.eet'conform to all applicable regulations of the district in which it is pro- <br /> posed to be located. <br /> For Conditional Uses in the A-1 Agriculture (Exclusive) District, the Following Additional Findings Shall be Made: <br /> 1. This use will aet benefit the needs of either the residents or the agricultural activities in the area. <br /> 2. There are not other locations available for this use. <br /> 3. The land to be occupied by this use is not productive agricultural land. <br /> • <br /> 4. Public services needed by this use are seeP'available. <br /> 5. Public services needed by this use can ae!'be furnished without becoming an unreasonable burden on the taxpayers. <br /> 6. This use at this location will not cause significant harm to the environment. <br /> WI That the applicant has given the necessary guarantee detailed on Exhibit "A" attached hereto and incorporated by re- <br /> /T "Terence. <br /> That the conditions detailed in Exhibit "B" are specifically made applicable to this permit; and any violation of such <br /> conditions shall be sufficient grounds for revocation of this permit. <br /> WHEREFORE IT IS ORDERED: that the application for conditional use permit no. 9 Ole bit, and the same is hereby <br /> gran to d/de'94ir <br /> AGRICULTURE, ENVIRONMENT & ZONING COMMITTEE <br /> Date: FEB 2 6 1991 <br /> CONDITIONS: <br /> 1) . The permit is issued for 2 asphalt plants which shall be utilized solely for the produc- <br /> tionof aspahlt for highway construction projects. <br /> 2) . The permit is issued for 1991 only. <br /> 3) . Site preparation shall comply with the environmental containment plan for the asphalt <br /> plants which was approved by DILHR on 2/12/91. <br /> 4) . Reclamation of the plant sites shall consist of the following: <br /> a) . The areas of the plant sites and aggregate piles shall be restored. <br /> b) . The areas shall be leveled and any remaining aggregate, blacktop, etc., shall be removed <br /> The topsoil removed for the preparation of the sites shall be replaced. <br /> c) . Care shall be taken that the restoration will not cause or be subject to erosion. <br />
