Inc. <br /> (hereinafter either individually or collectively "Grantor") own in fee <br /> simple the following described real estate (hereinafter"Property") in <br /> the Town of Roxbury, in the County of Dane, Wisconsin, further Recording Area <br /> located at the following address: <br /> . Name and Return Address: <br /> and is further described as follows: The Heffron Company,Inc. <br /> 2000 Prairie St.,Ste 220 <br /> Legal Description: Lot Nine (9), Blackhawk Fields, in the Prairie du Sac,WI 53578 <br /> Town of Roxbury, Dane County, Wisconsin. <br /> 050/0907-183-1519-0 <br /> Parcel Identifier Number <br /> WHEREAS, Grantor desires to place certain restrictions on the Property, to bind the Grantor <br /> and all those who may acquire any and all interest in, assignment of, or title to the Property <br /> hereafter. <br /> WHEREAS, the restrictions provided herein shall be enforceable at law or equity against any <br /> party who has or acquires any interest the Property subject to these restrictions by the following <br /> entities who are herein named as grantees and beneficiaries with enforcement rights: <br /> • The County Government of County of Dane, Wisconsin <br /> • The Town Government of the Town of Roxbury, Dane County, provided that the lands <br /> are within the jurisdiction of said Town at the time the enforcement action is <br /> commenced, and; <br /> • The owner(s) of record of any lands that are served by the same community septic <br /> system. <br /> WHEREAS, the above described property is within the Blackhawk Fields Subdivision, as <br /> recorded in Volume 59-047b of Plats, Pages 229-230, Dane County Register of Deeds <br /> document#4390294, located in the S1/2 of Section 18, T9N, R7E, Town of Roxbury, Dane <br /> County, WI (hereinafter"Subdivision").; <br /> WHEREAS, the lots within the Subdivision are served by common private sewage systems; <br /> WHEREAS, the common private sewage systems have capacity limitations with regards to the <br /> number of bedrooms served by each system; <br /> WHEREAS, single-family dwellings within the Subdivision have been limited to the maximum <br /> number of bedrooms for each dwelling served by the community septic system; <br /> WHEREAS, the Restrictions imposed herein are intended to comply with the requirements for <br /> private sewage systems found under Dane County Code of Ordinances Chapter 46: Private <br /> Sewage System Ordinance and Health Ordinance. <br /> NOW THEREFORE, the Grantor, as owner of the Property, declares that the Property is held <br /> and hereafter shall be conveyed, subject to the following restrictions: <br /> • There shall be no more than 4 bedrooms designed or constructed within the single- <br /> family dwelling located on the property. Any remodeling or reconstruction of the <br /> dwelling to include additional bedrooms shall be considered a violation of these <br /> restrictions. • <br /> A bedroom shall be defined as a habitable room which has a storage closet as an <br /> integral part of the room. <br />
