DEED RESTRICTION Limiting the number of bedrooms for the single family dwelling on the property WHEREAS, The Heffron Company, Inc. (hereinafter either individually or collectively "Grantor") own in fee simple the following described real estate (hereinafter"Property") in the Town of Roxbury, in the County of Dane, Wisconsin, further Recording Area located at the following address: . Name and Return Address: and is further described as follows: The Heffron Company, Inc. 2000 Prairie St.,Ste 220 Legal Description: Lot Nine (9), Blackhawk Fields, in the Prairie du Sac,St.,Ste 53578 Town of Roxbury, Dane County, Wisconsin. 050/0907-183-1519-0 Parcel Identifier Number WHEREAS, Grantor desires to place certain restrictions on the Property, to bind the Grantor and all those who may acquire any and all interest in, assignment of, or title to the Property hereafter. WHEREAS, the restrictions provided herein shall be enforceable at law or equity against any party who has or acquires any interest the Property subject to these restrictions by the following entities who are herein named as grantees and beneficiaries with enforcement rights: • The County Government of County of Dane, Wisconsin • The Town Government of the Town of Roxbury, Dane County, provided that the lands are within the jurisdiction of said Town at the time the enforcement action is commenced, and; • The owner(s) of record of any lands that are served by the same community septic system. WHEREAS, the above described property is within the Blackhawk Fields Subdivision, as recorded in Volume 59-047b of Plats, Pages 229-230, Dane County Register of Deeds document#4390294, located in the S1/2 of Section 18, T9N, R7E, Town of Roxbury, Dane County, WI (hereinafter"Subdivision").; WHEREAS, the lots within the Subdivision are served by common private sewage systems; WHEREAS, the common private sewage systems have capacity limitations with regards to the number of bedrooms served by each system; WHEREAS, single-family dwellings within the Subdivision have been limited to the maximum number of bedrooms for each dwelling served by the community septic system; WHEREAS, the Restrictions imposed herein are intended to comply with the requirements for private sewage systems found under Dane County Code of Ordinances Chapter 46: Private Sewage System Ordinance and Health Ordinance. NOW THEREFORE, the Grantor, as owner of the Property, declares that the Property is held and hereafter shall be conveyed, subject to the following restrictions: • There shall be no more than 4 bedrooms designed or constructed within the single- family dwelling located on the property. Any remodeling or reconstruction of the dwelling to include additional bedrooms shall be considered a violation of these restrictions. A bedroom shall be defined as a habitable room which has a storage closet as an integral part of the room.
