4
June 3, 1991
Land Regulation and Records
Zoning and Natural Resources Committee
Room 116 , City-County Building
Madison, Wisconsin 53709
Attention: Shary Bisgard, Chairperson
Re: Conditional Use Permit for an Art Gallery and
Liquor License
Dear Ladies and Gentlemen:
I feel extremely strongly that the granting of a Conditional Use
Permit for the above-mentioned subject is not within the spirit
and intent for which the law was written. Yes , the few technical
points of the law can be met , but clearly this business is a
traditional shopping center type of business and should be in an
area zoned for business !
1 . It has an inordinate amount of traffic compared to any of
the surrounding residential areas . If all houses did this ,
we would have a disaster on our hands .
2 . It is grossly unfair to the surrounding existing owners .
3 . It "substantially impairs and diminishes the values and
enjoyment of surrounding properties" with consistent special
occasions , evening, weekend, and holiday hours .
4 . It has multiple product lines .
5 . It provides services in addition to products .
6 . It requires a retail license to sell some of its products .
7 . It will host large planned gatherings with extensive
advertising.
8 . It has evening, weekend and holiday hours .
9 . It has signage .
10 . The property is being bought to house a business - the
living quarters aspect is incidental .
11 . This home was chosen because it is as close to a Regional
Shopping Mall (their north property line is the City of
Madison) as you can possibly get , and not be in the City.
With this close proximity, there will be large amounts of
traffic generated, not as if it were out in the country
somewhere .
