Land Regulation and Records
Zoning and Natural Resources Committee
Page Two
June 3 , 1991
12 . I cannot believe the statement made by the applicants that
there are days and weeks with no customers . I have been at
and by their present operation in McFarland three times and
there were customers there every time . Their present
customer frequency should not be considered because it will
be going much higher; otherwise they would not be wanting to
move.
This property is clearly being bought to be operated as a full
time traditional retail business , the same as any shopping center
location, and contained in that fact is the strongest reason for
my concerns . Once this business is established, they will want
to add products , expand, etc . We could soon have a commercial
district right amongst a tremendous amount of residential
investments , that many people have made and there would not even
be some traditional transitional uses between this commercial use
like duplexes and/or open spaces - 5 single family lots abut this
property directly on the north in addition to my home in the
town.
I feel so strongly about this whole project , that without proper
conditions attached to any permit granting, I would be forced to
get many neighbors (who have not been contacted) involved, along
with myself , and carry this matter on in whatever legal direction
is open to us , until it is resolved satisfactorily.
If the applicants ' wishes for a permit are as innocent and low-
keyed as they would like me and you to believe , then they should
not care if reasonable conditions must be met . After all , they
would be imposing severely on the peaceful enjoyment and values
of surrounding property; even shopping centers have operating
rules . If the applicants are unwilling or unable to abide by
some simple , reasonable conditions , then it means they intend to
exceed or violate them which by definition means they should have
proper zoning and be in a shopping center ! This request should
not be granted. If it is , it should have the following
reasonable conditions so that during the disputed period of
operation, it will be tolerable until the neighbors can legally
get it removed. I therefore submit the following conditions for
approval , NONE OF WHICH PROHIBIT THEM FROM CARRYING OUT WHAT THEY
WANT TO DO:
