ZONING ORDINANCE AMENDMENT NO. 5030 Amending Section 10.03 relating to Zoning Districts in the Town of DUNN The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Dunn be amended to include in the R-3A Residential and RH-3 Rural Homes. District the following described land: Pet. #5030: Part of the SE 1/4 NE 1/4 - Section 19, Town of Dunn described as follows: TO R-3A: Commencing at the Northwest corner of said NE 1/4 SE 1/4; thence East 330 feet along North line said NE 1/4 SE 1/4 to point of beginning; thence South 200 feet; thence East 200 feet; thence North 200 feet; thence West 200 feet to the point of beginning. TO RH-3: Commencing at the Northeast corner of said NE 1/4 SE 1/4 and point of beginning; thence West along North line of said 1/4 1/4 797.5 feet; thence South 200 feet; thence West 200 feet; thence South 115 feet; thence East 200.3 feet; thence South 425 feet; thence East 799.5 feet to East line of said 1/4 1/4; thence North 740 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: A. The area zoned RH-3 shall not be divided. B. Accessory buildings in the RH-3 area shall be located in the Westerly 200' of the property, South of the R-3A area, as specified by the site plan submitted by the applicant. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of the land. Failure to record the restrictions will cause the rezone to be null and void.
