Appeal by Elizabeth Dudzik for variances from minimum required lot area and <br /> minimum required lot width at the building setback line for an existing substandard platted property in <br /> the Shoreland District as provided by Sections 11.03(1) and 10.05(4), Dane County Code of <br /> Ordinances, to permit new single-family residence replacing razed flood-damaged residence at 396 <br /> Lake Shore Drive, being Lot 5 and South Half Lot 6, Block 2, Edgerton Beach Park, Section 25, Town <br /> of Albion. <br /> COMMUNICATIONS: 07/30/2009 Town of Albion acknowledgment. <br /> VARIANCES REQUESTED: Purpose: Replace single-family residence more than 50% damaged by <br /> June 2008 Lake Koshkonong floods, on substandard platted property in the Shoreland district. <br /> Lot Area Variance: <br /> Minimum lot area required: 15,000 square feet (SF) <br /> Actual lot area: 11,658 SF <br /> VARIANCE NEEDED: 3,342 SF <br /> Lot Width Variance <br /> Minimum lot width at building setback line required: 100 feet <br /> Actual lot width: 57.3 feet at building setback line <br /> VARIANCE NEEDED: 42.7 feet <br /> IN FAVOR: Elizabeth Dudzik, Hoffman Estates, IL. <br /> ZONING ADMINISTRATOR'S COMMENT: Moving the house farther from the Ordinary High Water <br /> Mark and side lot lines improves compliance with Zoning and Shoreland Ordinance requirements. <br /> OPPOSED: None <br /> Motion: Long/Colvin to grant variances of 3,342 square feet (SF) from the minimum 15,000 SF lot <br /> area required and 42.7 feet from the minimum 100 feet lot width at building setback line required to <br /> allow replacement of a flood-damaged single-family residence on a substandard platted lot in the <br /> Shoreland district, with CONDITION of Town of Albion approval. <br /> Finding of Fact: <br /> 1. Ms. Dudzik showed photos of a house she said had been owned by her family for 50 years. It was <br /> located on 1-% lots of a plat recorded in 1926, in the R-3 Residential district, and Shoreland and <br /> Floodplain districts of Lake Koshkonong. The house was about 24 feet x 30 feet in size and was <br /> located about 50 feet from the lake, according to a Shoreland Erosion Control Permit (SEP) site <br /> plan. <br /> 2. In June 2008, Lake Koshkonong flooding damaged the house more than 50%, requiring a <br /> decision to remove it or raise it to meet Floodplain Ordinance requirements. Dudzik removed the <br /> house in October 2008. <br /> 3. Dudzik proposes to build a one-story, 3-bedroom house. At 24 feet x 46 feet with a 6 foot x 24 <br /> feet deck on the lake side and a 4 foot x 24 foot ramp access on the south side, it would have no <br /> attached or detached garage, but would meet minimum side yards, front setback, and maximum <br /> lot coverage, with 11.5% proposed. <br /> 4. Dudzik emphasized the new house would be moved back from the lake to meet the minimum 71.9 <br /> feet averaged setback from Ordinary High Water Mark (OHWM), and would comply with all <br /> Shoreland and Floodplain Ordinance requirements. <br /> Conclusions: <br />
