Unnecessary Hardship: It would be unnecessarily burdensome to prevent the restoration of the <br /> permitted residential use of this property damaged by flooding. <br /> 2. Unique Limitations of the Property: The June 2008 floods created the hardship for Lake Shore <br /> Drive property owners; it was not self-imposed. <br /> 3. No Harm to Public Interests: The applicant is willing to meet all Shoreland and Floodzone <br /> requirements, and requests minimal relief, as illustrated by the low lot coverage percentage and <br /> improved setback from OHWM. <br /> Motion carried: 5—0. <br /> IV. OTHER BUSINESS <br /> Chair Schulz mentioned he had spoken with County Executive Kathleen Falk earlier in the day, and <br /> related that she expressed thanks and appreciation for the efforts of the Board to provide a valuable <br /> service to the citizens on the County. <br /> 1. Zoning Administrator's and Assistant Zoning Administrator's Reports, including distribution of <br /> materials, if any, discussion, and possible action regarding the following topics: <br /> a. Report on re-appointment of Board member Al Long, and distribution of updated Board <br /> member contact list: Schutte told the Board the reappointment of All Long had been confirmed <br /> by the County Board of Supervisors on 08/06/2009. His term will expire 06/30/2012. Schutte <br /> also distributed updated contact information sheets to the Board members present. No action <br /> was taken by the Board. <br /> b. Distribution of copies of the "Lamar case" (Wisconsin Supreme Court Case: Lamar Central <br /> Outdoor, Inc. v. Board of Zoning Appeals of the City of Milwaukee, Appeal Number <br /> 2001AP003105, July 12, 2005) for information only: Schutte distributed copies at the request <br /> of Board member Al Long, with the agreement of the Chair. The Board discussed the <br /> significance of this case. No action was taken by the Board. <br /> c. Information about workshops for Zoning Boards of Adjustment/Appeals: Schutte distributed <br /> information for a 09/24/2009 "Zoning Workshop for Boards of Adjustment/Appeals" to be held <br /> on September 24, 2009, the only workshop she could find in the near future. New Board <br /> member Colvin had asked to be notified of any such workshops. Schutte also distributed <br /> information from the Center for Land Use Education, which presents such workshops for a <br /> minimum of 30 people, and asked the Board if she should contact Center staff about having a <br /> workshop in Dane County. Chair Schulz concurred. Studz suggested a new Second Alternate <br /> might benefit from a workshop as well. The Board discussed the need for and possible <br /> sources for Alternate candidates. No action was taken by the Board. <br /> d. Distribution of list of"Shoreland Lot Width, Lot Area and Lot Coverage Appeals after Appeal <br /> 3437," including variance appeals in area affected by June 2008 Lake Koshkonong flooding, <br /> Section 25, Town of Albion: Schutte presented a document listing results of the Board's action <br /> on Appeal 3437 --the "Arboretum case," which resulted in more variance applications for lot <br /> width, area, and coverage in the Shoreland district. She and the Board discussed the possible <br /> uses of the list. She will keep the list up to date, and may post it on the Zoning Division web <br /> site. Chair Schulz asked Schutte to send the document to board members via email. No <br /> action was taken by the Board. <br /> e. Draft amendments to the Dane County Board of Adjustment Rules and Procedures: Schutte <br /> presented the most current, updated version of the rules, which incorporated discussions at <br /> earlier Board meetings, as well as a Q&A sheet with details of all resulting changes. The <br /> Board discussed the corrections and further revisions in detail. Chair Schulz directed Schutte <br /> to prepare a final draft of the revised Rules and Procedures for action by the Board. Schutte <br /> noted the Board's action on the amendments to their Rules would not be subject to approval <br /> by the County Board of Supervisors. No action was taken by the Board. Zoning Administrator <br /> Roger lane left the meeting at 9:06 p.m. <br /> Board member Carlton Hamre left the meeting at 9:10 p.m. A quorum was still present. <br /> f. Ordinance Amendment regarding temporary structures in the Airport Height Limitation Zone: <br /> No discussion; no action was taken by the Board. <br />
