DRIVEWAY EASEMENT <br /> EASEMENT <br /> Document Number <br /> THIS DRIVEWAY EASEMENT (this "Easement") <br /> is made and acknowledged as of , 2016, by <br /> Donald and Mary Hoffman, (hereinafter collectively <br /> referred to as the"Hoffmans"), husband and wife. <br /> RECITALS <br /> A. The Hoffmans own a parcel of real property <br /> in the Town of Springfield, County of Dane, State of <br /> Wisconsin, legally described as: A parcel of land in NW '/ Recording Area <br /> Name and Return Address <br /> of the NE '/ of Section 11 and SW '/ of the SE '/ of Section <br /> 2 all in the Town of Springfield, Dane County, Wisconsin. !Parcel Identification Number(PIN) <br /> Also known as address number: 6718 STH 19, Waunakee, <br /> WI 53597-9202. <br /> This parcel of real estate is known herein as the Original <br /> Parcel. <br /> B. The Hoffrnans intend to record a Certified Survey Map (CSM) to divide the <br /> Original Lot into two lots, one of which will contain their current residence, and the other of <br /> which will be a new parcel of real estate for the purpose of construction of a residence. The <br /> Hoffmans desire to grant the purchaser of that new parcel the right to shared use of the current <br /> driveway access which connects the Original Lot to Wisconsin Highway 19. <br /> NOW THEREFORE, in consideration of the recitals, the mutual covenants of the Parties <br /> and other good and valuable consideration, the receipt and sufficiency of which is <br /> acknowledged, the Hoffmans convey the following easement in real estate as a servitude and <br /> burden on the CSM lots, according to the terms hereof: <br /> 1. Definitions. For purposes of this Easement, the following phrases or terms shall <br /> have the following respective meanings. Other terms and phrases are defined elsewhere in the <br /> text of this Easement and, throughout this Easement, those terms and phrases shall have the <br /> respective meanings given to them. <br /> 1.1. "Parcel" or "Parcels" shall mean any or all, as the case may be, the real <br /> estate owned by the Hoffman's and including lands in NW '/ of the NE '/ of Section 11 <br /> and SW '/ of the SE `/ of Section 2 all in the Town of Springfield, also including Lot 1 <br /> of CSM <br /> 1.2. "Parcel Owner" or "Parcel Owners" shall mean any or all, as the case may <br /> be, of the current or future owners of a Parcel or Parcels. <br />
