1.3. "Access Driveway" shall mean a gravel or pavement-covered area which <br /> is used for access and is built to applicable Town standards, if any, for the purpose of <br /> ingress and egress from Lot 1 to State Highway 19. The Access Driveway shall be <br /> constructed, replaced or relocated pursuant to this Easement and as it may be realigned, <br /> replaced or relocated from time to time pursuant to this Easement. <br /> 1.4. "Common Driveway" shall mean a gravel or pavement-covered area <br /> which is used for access to Wisconsin Highway 19 by lands owned by the Hoffman's in <br /> the NW 1/4 of the NE `/ of Section 11 and SW '/ of the SE '/ of Section 2 all in the Town <br /> of Springfield and Lot 1 of CSM <br /> 1.5. Parcel 1 or Parcel 2. <br /> 1.6. "Original Driveway" shall mean the gravel or pavement-covered area <br /> which is used for access from the existing Hoffman residence and farm, to Wisconsin <br /> Highway 19. <br /> 2. Recitals. The Parties approve and ratify the Recitals. <br /> 3. Driveway Easement. <br /> 3.1. Ingress and Egress Driveway for Lot 1. The Parties hereby agree that the <br /> owners of Lot 1 shall have the right to construct, maintain and use the Original Driveway <br /> for ingress and egress to Lot 1. The owners, licensees and invitees of Lot 1 may ingress <br /> and egress from Lot 1 to Wisconsin Highway 19 using the Original Driveway and the <br /> Common Driveway. <br /> 3.2. Ingress and Egress Driveway for Lands. The Parties hereby agree that the <br /> owners of said lands in section 2 and 11 shall have the right to construct, maintain and <br /> use the Access Driveway for ingress and egress to Lot 1, which shall connect to and <br /> proceed from points on the southwesterly side of the Original Driveway. The owners, <br /> licensees and invitees of Lot 1 may ingress and egress from Lot 1 to Wisconsin Highway <br /> 19 using the Access Driveway and the Common Driveway. <br /> 3.3. Initial Construction Costs of New Driveway Segment. The Owners of Lot <br /> 2, without expense to the Owners of Lot 1, shall connect the Access Driveway to the <br /> Existing Driveway. The surface of the Access Driveway shall be of a quality at least <br /> equal to the quality of the surface of the other segments of the existing driveway. The <br /> owners of Lot 2 shall bear the entire cost of construction of the Access Driveway, and <br /> any costs of restoration of the Existing Driveway which result from construction of the <br /> Access Driveway. <br /> 3.4. Reconstruction. In the event that the owners of Lot 1 decide to pave the <br /> Existing Driveway with asphalt, the Owners of Lot 2 shall pave the Access Driveway <br /> with the same asphaltic material and base. The Owners of Lots 1 and 2 shall share <br /> equally the cost attributable to paving the Common Driveway. <br />
