Y
ecologist to delineate the wetlands remaining on his property, and he needs to learn
more how to obey the letter and the spirit of these laws.
Finally, I think it is important to point out that if the fill is removed very soon
from the illegally filled area, there is a good chance that the wetland will recover
quickly. The longer the fill remains in place, the more difficult it will be for the area to
be restored to its original condition. At this point in time Mr. Fox has already been
ordered by the Army Corps of Engineers to remove fill her illegally placed in another
part of the marsh; he can conduct both restorations at the same time and save himself
some money.
In summary, the area in question is very important for protecting water quality,
particularly in view of the development all around. I speak for myself and all of our
members in Dane County when I say that we have already lost enough wetlands in
this County. It is time that the County officials such as yourselves took an active role
in upholding the zoning laws. The laws are clearly written to protect areas such as
this, which are critical in protecting the public health, safety and welfare. Denial of the
re-zoning request and restoration of the wetland area will not prevent Mr. Fox from
gaining any economic benefit from his land.
I thank you for your time and effort in reading this and considering my
comments. I would be happy to speak with you further on this matter at any time.
Sincerely,
l / 4(1,
Catherine R. Owen
Former Co-chairman
3
