Joint Driveway Agreement and Easements <br /> Champagne/Champagne <br /> Page 2 of 5 <br /> 1. Champagne explicitly states that this grant of easements and establishment of joint driveway areas <br /> shall survive the division of Parcel A and the closings on Lot I and Lot 2, as well as any future sale <br /> of the Farm Fields. <br /> 2. All references to the owners of Lot 1, Lot 2, and the Farm Fields herein shall include Champagne <br /> and the future owners of Lots 1 and 2 and the Farm Fields, their successors and assigns in tide. <br /> 3. Champagne, as owner of Lot 2, hereby grants to himself as owner of Lot 1 and the Farm Fields and <br /> his successors and assigns in title as the owners of Lot 1 and the Farm Fields an easement and right- <br /> of-way to use that part of Lot 2 described as the"Joint Driveway Easement Area' on Exhibit C <br /> attached hereto and incorporated herein, to be used jointly by the owners of Lotl, Lot 2, and the <br /> Farm Fields on the terms and for the purposes described herein. The easement area for the gravel <br /> driveway on Lot 2 shall be approximately thirty feet (30') in width as specifically described on <br /> Exhibit C attached hereto. This area shall be referred to herein as the"Joint Driveway Easement <br /> Area". <br /> 4. In addition, Champagne. as owner of Lot 2, hereby grants to himself as owner of the Farm Fields, an <br /> easement and right-of-way to use the current driveway located on Lot 2 extending from the end of <br /> the Joint Driveway Easement Area to the edge of the Farm Fields jointly with the owners of Lot 2 on <br /> the terms and for the purposes described here. This easement shall be approximately thirty feet(30') <br /> in width with the centerline of the current driveway being the centerline of this easement area. This <br /> area shall be described as the"Additional Farm Fields Easement Area" herein. <br /> 5. The Joint Driveway Easement Area may be used by the owners of Lot 1, their occupants, tenants. <br /> agents, employees, guests, licensees, and invitees, the owners of Lot 2, their occupants, tenants, <br /> agents, employees, guests, licensees, and invitees, and the owners of the Farm Fields, their <br /> occupants, tenants. agents, employees, guests, licensees, and invitees provided they abide by the <br /> terms and conditions herein stated. The Additional Farm Fields Easement Area may be used only by <br /> the owners of Lot 2, their occupants, tenants, agents, employees, guests, licensees, and invitees, and <br /> the owners of the Farm Fields, their occupants, tenants, agents, employees, guests, licensees, and <br /> invitees provided they abide by the terms and conditions herein stated. <br /> 6. The owners of Lot 1 and Lot 2 may use the Joint Driveway Easement Area for any purpose they <br /> wish, provided they abide by the terms and conditions herein stated. The owners of the Farm Fields <br /> may use the Joint Driveway Easement Area and the Additional Farm Fields Easement Area only for <br /> access to the Farm Fields for farming, hunting. other recreational purposes. and access to the <br /> billboard located on the Farm Fields. <br /> 7. The driveway in the Joint Driveway Easement Area is currently made up of dirt and gravel and is <br /> expected to remain dirt and gravel. If any party hereto causes any damage to such Joint Driveway <br /> Easement Area, such party shall be responsible for repairing such road by smoothing it down and <br /> adding gravel as needed. In the absence of intentional or negligent damage, the owners of Lots 1 and <br /> 2 shall be jointly and equally responsible for all ordinary care and maintenance of the Joint <br /> Driveway Easement Area and for the repair of damages caused by natural or weather relates causes. <br /> Repairs and maintenance shall be performed at such times and in such a manner as are mutually <br />
