Driveway Agreement and Easements <br /> Champagne/Champagne <br /> Page 4 of 5 <br /> Farm Fields shall have equal rights or ingress and egress over the Additional Farm Fields Easement <br /> Area and shall take no action to prevent the other party's enjoyment of such rights. Both the owners <br /> of Lot 2 and the owners of the Farm Fields shall be prohibited from placing any encroachment or <br /> obstruction in the Additional Farm Fields Easement Area, including parked vehicles, whether <br /> temporary or permanent, without the express permission of the other owner. <br /> 15. The owners of Lot I agree to indemnify and hold the owners of Lot 2 and the Farm Fields harmless <br /> from all liability, suits, actions, claims, costs, damages, and expenses of every kind and description, <br /> including court costs and reasonable legal fees, for claims of any character, brought because of any <br /> injuries or damages received or sustained by any person, persons, or property on account of or <br /> arising out of the use of the Joint Driveway Easement Area over Lot 2 by the owners of Lot 1, their <br /> occupants, tenants, agents, employees, guests, licensees, or invitees, except to the extent caused by <br /> the gross negligence or misconduct of the owners of Lot 2 or the Farm Fields or their occupants, <br /> tenants, agents,employees, guests, licensees, or invitees. <br /> 16. The owners of Lot 2 agree to indemnify and hold the owners of Lot land the Farm Fields harmless <br /> from all liability. suits. actions. claims, costs, damages, and expenses of every kind and description, <br /> including court costs and reasonable legal fees, for claims of any character, brought because of any <br /> injuries or damages received or sustained by any person, persons, or property on account of or <br /> arising out of the use of the Joint Driveway Easement Area on Lot 2 by the owners of Lot 2. their <br /> occupants, tenants, agents, employees, guests, licensees, or invitees, except to the extent caused by <br /> the gross negligence or misconduct of the owners of Lot 1 or their occupants, tenants, agents, <br /> employees, guests, licensees, or invitees. The owners of Lot 2 also agree to extend the same <br /> indemnification and hold harmless agreement to the owners of the Farm Fields as to the Additional <br /> Farm Fields Easement Area. <br /> 17. The owners of the Farm Fields agree to indemnify and hold the owners of Lots 1 and 2 harmless <br /> from all liability, suits, actions, claims, costs, damages, and expenses of every kind and description, <br /> including court costs and reasonable legal fees, for claims of any character, brought because of any <br /> injuries or damages received or sustained by any person, persons, or property on account of or <br /> arising out of his or her use of the Joint Driveway Easement Area on Lot 2 by the owners of the <br /> Farm Fields and his or her occupants, agents, tenants, employees, guests, licensees, or invitees, <br /> except to the extent caused by the gross negligence or misconduct of the owners of Lots 1 or 2, their <br /> occupants, tenants, agents, employees, guests, licensees, or invitees. The owners of the Farm Fields <br /> also agree to extend the same indemnification and hold harmless agreement to the owners of Lotl as <br /> to the Additional Farm Fields Easement Area. <br /> 18. All of the terms and conditions of this easement, including the benefits and obligations, shall run <br /> with and be appurtenant to the parcels of land described above, and shall be binding upon, inure to <br /> the benefit of and be enforceable by the owners of Lot 1, Lot 2, and the Farm Fields and their <br /> respective successors and assigns. The easements granted herein may not be transferred separately <br /> from. or severed from. title to the respective Lots, including the Farm Fields as Lot 3. Furthermore, <br /> the benefits of the easements granted under this Agreement shall not be extended to any properties <br /> other than Lots 1. 2. and 3 except as stated herein, without the consent of all parties. <br />
