i <br /> .,. •• RESTRICTIVE COVENANT AGREEMENT 2203.760 <br /> 3. <br /> Know All Men By These Presents, that Mark Rosenbaum, as the owner of the real <br /> estate described on Exhibit A attached hereto and made a part hereof <br /> (the "Property"), does hereby declare that the Property shall be subject to the • <br /> following restrictions, covenants, and conditions, for the term and time hereinafter <br /> specified. <br /> i4282 PAGE 36 <br /> 1. Restrictions on Use. The Property shall only be used for the storage, repair <br /> and maintenance of rock crushing and excavating equipment. If the Property ceases to <br /> be used for said purposes for a period of six consecutive months, the Town of <br /> Dunkirk, Dane County, Wisconsin shall have the right to change the zoning on the <br /> Property to A-1 Ex. Agriculture. <br /> • <br /> • <br /> 2. Term. The covenants in this agreement constitute covenants running with the i <br /> land and shall be binding upon all persons at any time having any interest in the <br /> Property and shall remain in effect for a period of twenty-five (25) years from the <br /> date this agreement is recorded, and after which time said covenants shall be <br /> extended automatically for successive periods of five (5) years unless an instrument <br /> signed by the then owner of the Property is recorded agreeing to change of terminate - <br /> said covenants. <br /> 3. Purpose of Covenant. The Town of Dunkirk requires that these covenants be <br /> • imposed on the Property as a precondition to changing the zoning of the Property from <br /> A-1 Ex. Agriculture to C-2 Commercial. The C-2 Commercial zoning of the Property <br /> shall apply to any subsequent owner of the Property as long as the covenants set <br /> forth herein are complied with. <br /> 4. Enforcement.
