4 . The foregoing parcel of land is zoned A-1 Agricultural <br /> District (Exclusive) under the Zoning Code of Dane County, <br /> Wisconsin . Only agricultural uses are permitted under this zoning <br /> classification . <br /> 5. At the regular meeting of the Town Board of the Town of <br /> Roxbury held on March 19, 1990 , plaintiff' s petition , No . 4732 to <br /> rezone the property described in paragraph 3 above from A-1 <br /> Agriculture District (Exclusive) to RH-3 Rural Homes District, Dane <br /> County Zoning Ordinance said Board voted to grant plaintiff ' s <br /> petition to rezone said parcel . At said meeting the Town Planning <br /> Committee reported that plaintiff ' s rezoning petition fits into the <br /> Land Use Plan of the Town of Roxbury. <br /> 6. RH-3 Rural Homes District - 3 permits all uses permitted <br /> in the RH-1 Rural Homes District and all conditional uses permitted <br /> in the RH-1 Rural Homes District; the original petition submitted <br /> by the plaintiff would have permitted three lots on 35 acres each; <br /> however , the petition was amended to authorize two lots on 22 acres <br /> each . <br /> 7 . On July 5, 1990 , plaintiff ' s petition No . 4732 for <br /> rezoning came before the regular meeting of the Dane County Board <br /> on the recommendation for approval and adoption of the County Board <br /> Zoning and Natural Resources Committee. By a vote of 33 Noes and <br /> 5 Ayes the motion failed of adoption . <br /> 2 <br />
