Bisgard and Members : <br /> On behalf of the Town of Middleton, I submit the following <br /> information for your Committee in review of our conditional use <br /> permit #745 . <br /> Our request is for governmental uses under s . 10 . 12 ( 2 ) (k) of the <br /> Al Agricultural District. Under the governmental definition of <br /> s . 10 . 01 ( 23a) , I quote: <br /> Governmental uses : shall include but not limited to <br /> parks , playgrounds , schools , hospitals , police and <br /> fire stations, solid waste disposal sites and <br /> recreational areas . <br /> I believe that the Town of Middleton' s plan to construct a Town <br /> Hall facility and park falls clearly within the governmental uses <br /> definition. As expressed to you in the public hearing, there will <br /> be a recreational area that may include baseball diamonds and other <br /> recreational activities, a town hall site , and the possibility of <br /> the Dane County Sheriff' s station. <br /> It has been raised by others that the use of this area for <br /> baseball/softball diamonds that have lights should require <br /> additional conditional uses under s . 10 . 10 of the County Ordinances <br /> ( recreational district) . I do not believe this to be the case. I <br /> believe the recreational district implies a private user versus <br /> that of a governmental use. Under the definition of governmental <br /> uses , as allowed for in the Al District , I believe that the issue <br /> of lights could be determined under the current petition. This, <br /> however, is not the intent of the Town of Middleton. <br /> The Town of Middleton has indicated to its citizens that the <br /> issue of lighted ball diamonds will be a matter of future <br /> discussion. Although it may not be necessary to have a County <br /> conditional use to have such lighted ball diamonds , the Town is <br /> requesting that a conditional use permit be required if and when <br /> lighting for ball diamonds is requested. <br />
