Adequate utilities, access roads and other <br /> site improvements have been or are being <br /> made. ( 610. 255( 2) (h) (4) ) <br /> The proposed use required no utilities. The only access <br /> road needed is a new driveway. Drainage will be maintained in <br /> accordance with Town of Middleton Ordinances. No other site <br /> improvements are needed. <br /> 5. Adequate measures have been or will be taken <br /> to provide ingress and egress designed to <br /> minimize traffic congestion in the public <br /> streets. ( §10. 255( 2) (h) ( 5) ) <br /> The proposed usage will not involve a site that is open to <br /> the public. As such, it will not generate traffic and will not <br /> create congestion in the streets. The minimal truck traffic <br /> created by the operation will also not be sufficient to create <br /> congestion. <br /> 6. The conditional use shall conform to <br /> applicable regulations of the district in <br /> which it is located. ( §10.255( 1) (h) ( 6) ) <br /> The proposed use will be located in an A-1 district. The <br /> ordinances governing A-i districts regulate accessory buildings, <br /> storage of vehicles, building heights, road set-back and side <br /> yard requirements and off street parking. None of these <br /> regulations will be violated by the proposed use. <br /> We submit that the proposed conditional use meets the <br /> standards set forth in the ordinance and should be reaffirmed. <br /> In addition the use will comply with the 14 additional conditions <br /> which were set forth when the permit was granted. <br /> Control and enforcement <br /> Concern has been expressed that there is no enforcement <br /> mechanism to insure that the standards and conditions are <br /> followed. However, Section 10. 255( 2) (m) of the ordinances clearly <br /> states that the conditional use permit may be revoked by the <br /> zoning committee if the specified conditions are not met. We <br /> believe that the zoning committee would quickly learn of <br /> violations and therefore, this ordinance creates a strong <br /> enforcement provision. <br /> 3 <br />
