handling of topsoil and other materials on a larger scale than is <br /> contemplated on the proposed site. In light of these existing <br /> uses, we believe the proposed use is compatible with the <br /> surrounding properties. <br /> County Ordinance Standards <br /> Section 10. 255( 2) (b) of the Dane County Ordinances indicates <br /> that a conditional use permit shall not be denied if the <br /> standards set forth in the ordinances are met. Six standards are <br /> contained in Section 10.255(2) (h) and are as follows: <br /> 1. The conditional use will not be detrimental <br /> to or endanger public health, safety, comfort <br /> or general welfare. ( S10.255( 2) (h) ( 1) ) <br /> The proposed operation produces no toxic substances or <br /> chemicals and involves no production or dumping of hazardous by- <br /> products or wastes. Although the excavation activities will <br /> involve the use of trucks and machinery, this usage seems to be <br /> no more threatening than the agricultural machinery used on <br /> adjoining properties or the excavating equipment used on the <br /> adjoining Bruce Company property. Because of its small size and <br /> shallow depth, the actual excavation also seems to pose very <br /> little risk. <br /> 2. The uses, values and enjoyment of other <br /> property in the neighborhood for purposes <br /> already permitted shall be in no foreseeable <br /> manner substantially impaired or diminished <br /> by the proposed use. ( S10. 255(2) (h) (2) ) <br /> As described above, the surrounding properties have a <br /> definite rural character. In any given year, at least 90% of the <br /> proposed site will be planted in agricultural crops. Another 8% <br /> will be planted in grass cover, while only 1% to 2% of the <br /> property will at any time be actively undergoing excavation. <br /> After completion of the proposed excavations the entire site will <br /> again be returned to agricultural production. We submit that <br /> because the proposed site will continue to be used predominantly <br /> in the manner in which it has been used in the past, no adverse <br /> effects will be noted in the value or enjoyment of surrounding <br /> properties. <br /> 3. Establishment of the conditional use will not <br /> impede the normal and orderly development and <br /> improvement of the surrounding property. <br /> s10. 255(2) (h) ( 3 ) ) <br /> The past usage of the property has been to raise crops. <br /> Crops will continue to be raised on much of the property during <br /> the conditional use period and all of the property will be <br /> 2 <br />
