Bisgard: <br /> We respectfully request that the Committee reconsider <br /> Conditional Use Permit #747 granted to James Keleny, agent for <br /> Russell Hodgson, to allow mineral extraction (topsoil) on <br /> property located at 7377 Valley View Road in the Town of <br /> Middleton. <br /> Why reconsideration? We have appeared before the Town of <br /> Middleton Board and are familiar with the conditions as stated <br /> in Mr. Keleny's application for a Conditional Use Permit; <br /> however, we are concerned about changing the land use without <br /> additional conditions and guarantees to protect this property. <br /> First, had we been aware of the reapplication for a conditional <br /> use permit by Mr. Keleny to your committee, we would have come <br /> forth to alert the committee to these concerns . However, we <br /> were all unaware this issue was on your agenda. The purpose of <br /> this letter is to present our additional concerns . It is our <br /> hope that these are reasonable issues that you will agree need <br /> further investigation with regard to this permit. <br /> Issue #1: Back Fill. Soil contamination is of great concern to <br /> all citizens today with the rising discoveries of contaminated <br /> land. It is evident in this day and age that even the most <br /> honest business person may unknowingly use contaminated soil for <br /> back fill . If soil is brought into this property there should <br /> be conditions that require periodic testing for contamination <br /> ( for example, every three months) . <br /> Issue #2 : Boundary Limitations . According to the topographical <br /> maps of this property, some of the most fertile top soil lies on <br /> the southern boundary. This is right next to residential <br /> property. As with other such operations, a buffer zone of at <br /> least 300 feet should be imposed around the extraction area to <br /> protect neighbors and roadsides . <br /> N M 1 O 1989 <br />
