Page 2 <br /> Issue #3: Safety. There are 21 children in close proximity to <br /> this area and sites that are unsecured can, even with the most <br /> watchful parents, become playgrounds; they are "attractive <br /> nuisances . " Areas that pose such conditions should be enclosed, <br /> e.g. , by both erosion control and security fences . <br /> Issue #4: Operations . Implied, but not stated within these <br /> conditions, is the method of operation. Mr. Keleny indicated at <br /> the Town meetings that he would haul top soil to another site <br /> for holding, processing and distribution. This apparently means <br /> that no stock-piling mounds or shifting of dirt involving large <br /> machinery would be on this site. The method of operations <br /> should be spelled out. <br /> A second point regarding operations involves the number of years <br /> and hours of operation. We have seen the anticipated years of <br /> operation grow from five years to over twelve years as stated by <br /> Mr. Keleny's attorney at the Dane County Board of Supervisors <br /> meeting. A 7 : 00 a.m. to 7 : 00 p.m. operation, possibly seven <br /> days a week and holidays, over a twelve year period would <br /> certainly disrupt a residential environment to an unreasonable <br /> degree and for an unreasonable time. A time limit, for example <br /> three to five years of conditional use, should be stipulated. <br /> Issue #5: Road Conditions . It has been indicated to the Town <br /> Board by their Engineer that Valley View Road cannot withstand <br /> continual heavy traffic . Earlier this year, signs were posted <br /> to warn violators of weight limitations . Mr. Keleny and other <br /> businesses in the area have honored the assigned routes . <br /> However extending another business further down the road will <br /> only put added stress on the current road use as well as the <br /> additional road which includes a bridge on Valley View between <br /> this site and the presently used assigned route. <br /> Issue #6 : Method of Control. How will the approved conditions <br /> and the ones raised in this letter be monitored and by whom? <br /> This was the issue the Town Board and we feel most uncomfortable <br /> with in regard to the proposed operation. We by no means feel <br /> that Mr. Keleny would purposely violate the conditions, but they <br /> are certainly vital to protecting this land. If Mr. Keleny <br /> should sell his business, what are the guarantees that the new <br /> owner would meet these conditions? They must be specified, <br /> monitored and enforced so that the land is protected at all <br /> times . <br />
