Knickmeier, Petitioner <br /> Dear Sirs and Madams : <br /> I am sending you this introductory letter on behalf of my <br /> client, Robert A. Knickmeier, regarding the above matter. <br /> This paricular zoning Petition deals with the prospective <br /> re-zoning of a parcel consisting of approximately seven (7) <br /> acres located at the intersection of Zor Court, Colladay Point <br /> Drive, and U.S. Highway 51, in Section 23 , of the Town of Dunn. <br /> The request disclosed by the Petition is to re-zoning the <br /> entire parcel to zoning designation "R-3" , from a present <br /> split designation of "R-4" and "B-1" . <br /> Procedurally, this matter came before the Town of Dunn Land <br /> Use Planning Commission in September. The meeting was attended <br /> by approximately 52 interested persons, based on a head count <br /> which was conducted. The Land Use Planning Commission voted <br /> unanimously to support and approve the re-zoning request. <br /> This was later affirmed by the Dunn Town Board; and we do <br /> not have a precise count, but estimate that approximately <br /> 70 interested persons appeared at that meeting. <br /> Before proceeding further, I need to make a comment on ethics . <br /> Throughout the course of the background of this matter, I have <br /> endeavored to avoid pre-hearing contacts with persons who <br /> ultimately will be the decision-making parties . Research has <br /> led me to conclude that the present Dane County zoning situation <br /> does not represent any kind of quasi-judicial or administrative <br /> procedures, as lawyers normally understand such. This pro- <br /> cedure is instead quite frankly a pure, "legislative" process . <br /> It, therefore, seems to vest substantial discretion in those <br /> persons ultimately making decisions , and basically, opens <br /> the decision makers up to the usual panoply and variety of <br /> communications a legislative decision maker receives . It is <br /> in this vein that this material is forwarded to you as a pre- <br /> liminary introduction on behalf of the Petitioner. This is <br />
