The significance of the issues raised here are rather <br /> unique, and our general procedure does not seem to fit this <br /> situation very well . I want you to understand that I regret <br /> that more formal rules of evidence and normal judicial decision <br /> making do not apply in this case. In the interest of fairness , <br /> I am sending copies of these materials to the representative <br /> of the competing interest, Attorney Dennis Sieg. <br /> Getting back to the point, the property in question was appar- <br /> ently purchased by an uncertain group of individuals, with the <br /> actual Grantee being named as "Timothy T. Neitzel" . Mr. Neitzel <br /> is believed to reside at this time at 2374 County Trunk Highway <br /> "AB" , McFarland, Wisconsin 53558, in the Town of Dunn. A copy <br /> of the conveyance document I was able to discover is enclosed <br /> herewith as Item No. 1 in your packet; and it appears to be dated <br /> June 1, 1989 . Reports we have received indicate that apparently <br /> three other parties are involved, and would claim some kind of <br /> unascertainable "ownership" interest. These would be a Mr. <br /> David G. Gilbert; a Mr. Edward G. Gallagher; and a Mr. Robert <br /> Walgenbach. We believe that Mr. Walgenbach resides at 2331 <br /> Highway "AB" in the Town of Dunn. <br /> The immediate furor has arisen because of publicized plans of <br /> the owner and his compatriots to develop the parcel in question <br /> as a commercial apartment project, with anywhere from 36 to 80 <br /> units planned; with the possibility of more being built if pos- <br /> sible. A stronger unanimity of resistance to this project <br /> by local neighbors and residents of the Town of Dunn could hardly <br /> be imagined; with the exceptions being Mr. Neitzel , Mr. Walgen- <br /> bach, and perhaps their family members . <br /> The neighborhood in question here has historically been a <br /> quiet, residential neighborhood, with shady, oak-lined streets ; <br /> a large area of woods on Colladay Point; Indian mounds , and <br /> a lot of children on bicycles . This clearly would all pass <br /> away if the developers' plans come to fruition. <br /> Enclosed is as Item No. 2 for your edification, a copy of <br /> the Petitioner' s Preliminary Outline of factors supporting <br /> "R-3" as the appropriate zoning designation for the property <br /> in question. As Item No. 3 , we are also enclosing herewith <br /> some unfortunately poor quality photocopies of color photographs <br /> of the area, giving you a very precise idea of its characteris- <br /> tics at this time. <br />
