Klein <br /> 2485 Pinto Trail <br /> McFarland, WI <br /> Dear Phil , <br /> I would like to touch on two points concerning the rezoning <br /> of the piece of property in the Town of Dunn bordered by Hwy 51 , <br /> Colladay Point Drive and Zor Court. <br /> The first point concerns the "taking" question. Something <br /> that was never brought up during the public hearing regarding <br /> this rezoning is the fact that the developer, Mr. Gilbert, does <br /> not own the property in question. The owners name that appears <br /> on the deed is Tim Neitzel , 2374 Hwy AN, McFarland, WI . . Mr. <br /> Gilbert brought up the point that he does not build single family <br /> homes, only apartments. Since Mr . Gilbert does not own the <br /> property, that fact is irrelevant. Mr. Neitzel is free to <br /> contract with any developer he wishes, including a developer that <br /> does build single family homes. <br /> The second point concerns the suggestion that the property <br /> owners on and around Colladay Point should get together with the <br /> developer and work out some sort of compromise. The property <br /> owners and Mr. Gilbert have met on three occasions at the Town of <br /> Dunn hall . On July 17, September 11 , and September 19. At each <br /> meeting the concerns of both sides were aired and the suggested <br /> compromise of single family home development was put forth. <br /> Following are quotes from Mr. Gilbert that were transcribed from <br /> the audio tapes of those meetings. The tapes are currently in <br /> the possession of Town Clerk Rosalind Gausman. I have an edited <br /> version of those tapes containing the following quotes. Please <br /> excuse the language used, the quotes are exact. <br /> Plan Commission meeting of July 17, 1989: <br /> Mr. Ron Larson asked Mr. Gilbert what the plans were for the <br /> property: part of Mr. Gilbert' s response was, "They would be <br /> eight unit buildings um and I' m lookin' at about eighty units. "_ <br /> Mr. Larson then asked "Are there any, do you have any other <br /> options for the property, Mr. Gilbert, that you thought of?" <br /> Mr. Gilbert' s reply, "No. That' s the main reason I purchased it <br /> was for apartments, ' cause it was already zoned for it. " <br /> Mr. Larson pointed out that only part of the property was zoned <br /> for apartments. <br /> Mr. Gilbert' s reply, "Ya know, either I could lay it all out and <br />
