Wade, Chairperson <br /> Town of Middleton <br /> 3256 Timber Lane <br /> Verona, WI 53593 <br /> Dane County Agriculture, Environment <br /> and Land Records Committee <br /> RE: Conditional Use Permit #790 Ukn 12 1989 <br /> Dear Committee Members: <br /> yONi i U$'J. <br /> On December 11, 1989 the 'Town of Middleton Board approved C.U.P. #790 <br /> in a 2 to 1 vote. I present my dissenting opinion here and ask that <br /> you use your regional viewpoint to ensure that the concerns described <br /> below are adequately addressed. <br /> General Site Characteristics <br /> 1. Adjacent to Upper Black Earth Creek, a Wisconsin Priority Watershed. <br /> 2. Within or adjacent to the area marked for natural resource <br /> protection in the draft Dane County 1990-95 Parks and Open Space <br /> Plan <br /> 3. In an area designated as Permanent Open Space Protection in the City <br /> of Madison Peripheral Area Development Plan <br /> 4. The site is approximately one mile east of the Refuse Hideaway <br /> Landfill which is presently leaking contaminants into the <br /> surrounding groundwater. While the present flow of contaminants <br /> appears to be in a direction away from the proposed site, it is very <br /> possible the continued increase in groundwater pumping from the <br /> adjacent metropolitan areas will reverse the groundwater flow <br /> direction toward the CUP #790 site area. <br /> 5. The proposed CUP provides no limits to the size, height, or number <br /> of buildings or the number of daily and weekly site users. <br /> 6. The present Town of Middleton Plan and Ordinances are inadequate to <br /> provide guidance for this proposed development. A land division <br /> moratorium is in effect while natural resource inventories are <br /> underway and a new master plan is being drafted. <br /> 7. The site is proposed to be served by a on-site water supply well . <br /> 8. Wastewater is proposed to be disposed using an on-site wastewater <br /> system. These systems do not significantly remove nitrogen from the <br /> effluent. The majority of the wastewater nitrogen is expected to <br /> enter the groundwater system and discharge to Black Earth Creek. <br /> Average nitrogen loading from a residential wastewater system is 11 <br /> lbs. per person per year. While it is recognized 24 hour use of the <br /> site is not expected(though not precluded by the CUP) , the <br />
