The groundwater flow direction at the site is most likely from north <br /> to south toward Black Earth Creek. The most likely area for the - <br /> wastewater absorption fields would be north of the building site. <br /> If a water supply well is constructed adjacent to the building <br /> according to standard practice, then wastewater contaminants would <br /> move in the direction of the well with the very real potential for <br /> drawing those contaminants into the water supply. Present State <br /> requirements of placing wells greater than 50 feet from wastewater <br /> absorption fields does not adequately address this problem. <br /> In summary, I recommend CUP #790 not be granted since the proposed use <br /> cannot meet the required standards of the Dane County Code of <br /> Ordinances Chapter 10.255(2) (h)1 . , " That the establishment, <br /> maintenance, or operation of the conditional use will not be <br /> detrimental to or endanger the public health, safety, comfort, or <br /> general welfare. " This is evidenced by: <br /> 1 . The intensity of the proposed land use being contrary to "the <br /> comfort and general welfare" as expressed inn the desire of planning <br /> agencies to promote this area as part of regional open space and <br /> resource protection plans. <br /> 2. The site may be threatened by groundwater contamination emanating <br /> from the Refuse Hideaway Landfill . <br /> 3. The site design would allow contaminants from its on-site wastewater <br /> disposal system to flow through the area of its own water supply <br /> well . <br /> 4. Nitrogen contaminants from the wastewater system will add to the <br /> nutrient loading of Black Earth Creek. <br /> As an additional note I ask the Committee to recognize the intent of <br /> the CUP proponents to operate a nursery school for 8 or more children <br /> under 7 years of age. Section 10.12(2)4e) Dane County Code of <br /> Ordinances specifies that day care for more than 8 children is not a <br /> permitted use(See 10.01(19) for day care center definition) .
