EXHIBIT B <br /> Conditions and Restrictions <br /> HOURS OF OPERATION )/?7 �'2 F'&': 44= ' " <br /> 1. Operations, excluding blasting, may begin at 7:00 a.m. Monday <br /> - Friday. <br /> 2. Blasting may begin at 7 : 00 a.m. Monday - Friday. No blasting <br /> on Saturdays and Sundays. <br /> 3. Drilling and crushing shall cease at sunset or 9: 00 p.m. , <br /> whichever is the earlier, Monday - Friday. No drilling or <br /> crushing on Saturdays and Sundays. <br /> 4. Blasting shall cease at 5:00 p.m. Monday - Friday. <br /> Compliance with all applicable state and federal laws and <br /> regulations related to operations is required. <br /> AREA: The conditional use permit area ( "CUP area" ) shall be the <br /> northerly 600 feet, more or less, of the NE 1/4 of SE 1/4 of <br /> Section 26, Town 8N, Range 10E, Town of Burke, Dane County, <br /> Wisconsin. (Parcel No. 07-28-643) (Approximately 18.9 acres) <br /> BLASTING: Blasting will be done in accordance with the <br /> applicable restrictions contained in the Wisconsin Administrative <br /> Code regulations. When blasting, seismographic readings will be <br /> maintained below 0.40 in./sec. The seismograph will be located <br /> at various positions around the perimeter of the quarry <br /> property. This level is 20% below the ceiling allowed by the <br /> Wisconsin Administrative Code for blasting activities. When <br /> blasting is to be done, those neighbors living on Felland Road, <br /> from 5152 Felland Road to Burke Road, on Burke Road from Felland <br /> Road to Reiner Road, on Reiner Road from Burke Road to 5107 <br /> Reiner Road and all homes on Sandy Lee Lane will be notified in <br /> writing no less than eighteen hours in advance of the proposed <br /> blasting operation. The manner of giving notice will be by <br /> giving a copy of the notice to each such neighbor or leaving a <br /> copy of the notice inside or affixed to each such neighbor ' s <br /> door. In addition, other neighbors who have requested in writing _ <br /> to be notified in writing no less than eighteen hours in advance <br /> of the proposed blasting operation will be so notified. <br /> Seismograph records will be filed with Burke within seven (7 ) <br /> working days. <br /> - BERMS: Except as otherwise provided, a seeded berm will be built <br /> along the east boundary line of the CUP area and along Reiner <br /> Road not less than seven feet high' from the Reiner Road center <br /> line elevation with 3 to 1 slope on Reiner Road side. Except as <br /> otherwise provided, the top of the berm will be 24-30' feet from <br /> the east property line as constituted prior to the conveyance of <br /> right of way to Burke. A house currently exists on the SE corner <br /> -j ` 1 <br />
