WISCONSIN Mr. Dennis Reeves Mr. Lou Herro Impact Speedway 6262 West College Avenue Greendale, Wisconsin 53129 Gentlemen: As you know, the Town Board of the Town of Rutland has approved of the concept of greyhound racing at the race track. Approval of the concept came through the adoption of a Resolution conditionally approving of greyhound racing at the race track at the Special Town Board Meeting held December 22 , 1988 . We attach copies of the Resolutions actually passed for your convenience. The Town Board also passed a Resolution authorizing the creation of a Committee to identify the Town ' s concerns with regard to the race track so that those concerns could be addressed in the various documents that will need to be amended, created and executed before final approval can be given. This letter is intended to describe to you the present state of affairs so that you will have the official position of the Town of Rutland available for you to present to the various state authorities who have interest in the subject. You may use this letter to represent the position of the Town of Rutland with those authorities. Please be advised that before final approval for greyhound racing can be given by the Town of Rutland, a variety of things will have to be done. The entirety of the task is presently unknown and will be studied by the Committee. We are confident that several things will need to be done at minimum. First, the Town will propose necessary and desirable changes to the Deed Restrictions and Conditional Use Permit to both accommodate the proposed use of the track and to address concerns of the Town. In addition, we believe it will be necessary to execute one or more documents memorializing various oral commitments made by the track owners to the Town in enforceable form. The Town may seek other commitments through these separate agreements.
