same manner as public hearings for zoning amendment petitions are <br /> noticed and scheduled. Following such hearing, the committee <br /> shall issue a written report on the petition to the Dane County <br /> Board of Supervisors which shall, by majority vote, approve or <br /> reject the petition. Any amendment or termination of these <br /> restrictions shall also require the prior written approval of the <br /> Rutland Town Board. If approved, the petitioner(s) shall draft <br /> the necessary legal instrument, subject to the town and county's <br /> approval, and have it executed by the owner(s) of the Parcel and <br /> recorded. <br /> D. Costs. The owners shall reimburse the Town of Rutland <br /> for all costs incurred by the town in connection with the <br /> preparation and review of these deed restrictions or any <br /> subsequent amendments or termination thereof, as well as all costs <br /> incurred by the Town in seeking the enforcement of these <br /> restrictions at any time. Such costs may include but are not <br /> limited to actual attorneys ' fees, actual engineering fees and <br /> town administrative costs. The owners ball reimburse the town in <br /> full for such costs within 30 days of receipt of billing from the <br /> town. <br /> E. Security for Payment. The owners agree that they will <br /> be obligated to pay or reimburse the Town of Rutland for various <br /> costs in connection with the dog racing activity, including but <br /> not limited to, road improvements, traffic control, signage, plan <br /> review, and deed restriction amendment and enforcement.
