• <br /> DEED RESTRICTIONS <br /> 1 . WHEREAS, Don Simon, Inc. , a Wisconsin corporation is the <br /> Owner of the following described land in the Town of Madison, <br /> Dane County, Wisconsin (hereinafter the "Land" ) , to-wit: <br /> Lot One ( 1 ) , Certified Survey Map No. 4901 , recorded <br /> in Volume 22 of Certified Survey Maps of Dane County, <br /> page 3 , as Document No. , in the Town <br /> of Madison, Dane County, Wisconsin, being a part of the <br /> NE 1/4 of the NE 1/4 of Section 34 , TO7N, RO9E. <br /> 2 . WHEREAS, the said Owner desires to place certain <br /> restrictions thereon, to bind the Owner and those who may <br /> acquire title hereafter; <br /> 3 . NOW, THEREFORE, in consideration of the mutual benefits <br /> passing to and from the Owner and those who may hereafter <br /> purchase said land and the parties named as beneficiaries of <br /> these restrictions, the following restrictions are hereby <br /> imposed : <br /> A. The Land shall contain a single Apartment House Complex <br /> consisting of not more than twenty-four ( 24 ) residential <br /> dwelling units. <br /> B. Each residential dwelling unit shall have not more than one <br /> ( 1 ) bedroom. However, a dwelling unit may contain a separate <br /> room or area for a study or loft which shall not be used as <br /> sleeping quarters . <br /> C. Erosion control and storm water detention plans and <br /> specifications shall be prepared by the Professional Engineer <br /> licensed to practice in the State of Wisconsin according to <br /> the requirements of Chapter 14 . 53 of the Dane County Code of <br /> Ordinances using generally accepted professional standards <br /> and procedures . In addition, said plans shall show the <br /> location, size, height and contours of the storm water <br /> detention basin as well as the outflow structure and piping <br /> type, size and location necessary to channel storm water <br /> across to the North side of Carver Street . Said detention <br /> basin and water release structure shall be designed and <br /> constructed so as to safely contain and/or pass the runoff of <br /> a 100 year storm. <br /> D. All healthy trees in excess of 3 inches in diameter grouped • <br /> generally along and adjacent to the South and West boundaries <br /> of the Land shall be retained and shall be protected against <br /> damage during the period of construction. The Owner may <br /> prune and/or harvest said trees in accordance with the advice <br /> - 1 - <br />
