RESTRICTIONS - o --cf't . <br /> 1. WHEREAS, is/are <br /> the owner or owners of the following described land in the Town of <br /> , Dane County, Wisconsin, to-wit: <br /> Part of the NE 1/4 NE 1/4 of Section 34, Town of Madison described as <br /> follows: Lot #1, CSM 4901_.Volume. 22, Page 3, of Certified Survey Maps Dane <br /> County Register of Deeds Office. <br /> 2. WHEREAS, the said owner desires to place certain restrictions thereon, to <br /> bind the owner and those who may acquire title hereafter; <br /> 3. NOW, THEREFORE, in consideration of the mutal benefits passing to and from the <br /> owner and those who may hereafter purchase said land and the parties named as <br /> beneficiaries of these restrictions, the following restrictions are hereby im- <br /> posed: <br /> a) . Only one apartment building with no more than 24 apartment units is <br /> permitted. <br /> b) . Apartment units shall have not more than one bedroom. <br /> c) . Erosion control and storm water detention plans for a 100 year storm <br /> are required and must be approved by town. <br /> d) . Healthy trees in excess of 3" in diameter shall be saved and <br /> protected during construction. <br /> e) . Terrain contour, parking and landscaping shall be approved by the <br /> Town of Madison. <br /> These restrictions shall constitute covenants running with the land and shall <br /> be binding upon all parties now owning any part of said land, their successors, <br /> heirs and assigns, and all parties holding under them unless, pursuant to para- <br /> graphs 5 or 6 of this instrument, said restrictions are amended or terminated. <br /> - 1 - <br />
