• <br /> Pa V f '011 "dle /12-6r(-1 <br /> (Le&P"---frid/ 1988 Planning Commission Meeting of own <br /> Motion ,approved at July i 1�`, <br /> of Vermont, concerning proposal by Berry et.al . for rezoning part of <br /> the Tyrol Basin property from RE-1 to B-1. <br /> The Planning Commission unanimously approved the following <br /> recommendation to the Vermont Town Board: <br /> That the proposed re-zoning of a piece of the Tyrol <br /> Basin property, as shown on the application for rezoning, from RE-1 <br /> to B-1 be approved, if the proposal for re-zoning is accompanied by: <br /> a) an adequate mechanism (such as a deed restriction or a <br /> conditional use permit, etc.) to limit the uses of the entire <br /> property to the activities presented by Mr. Berry and associates. <br /> b)a conditional u4e permit for the RE-1 part of the property <br /> specifying the hooding of outdoor lighting, directing of that <br /> lighting toward the slopes, and the limiting the use of amplified, <br /> outdoor music to functions approved by the Town Board. <br /> c) a conditional use permit for the B-1 portion of the property <br /> to allow the operation of a tavern when the allowed activities <br /> quire such a service, and to limit the use of amplified, outdoor <br /> ::c to functions approved by the Town Board. <br /> These recommendations emerged for the following reasons . <br /> The re-zoning of part of the property from RE-i to B-1 is be ng <br /> requested on the recommendation of the County in order to permit <br /> operation of a ski shop which would not be possible under the RE-i <br /> zoning. However, this change means that a number of activities could <br /> be undertaken at the site, which are not presently contemplated but <br /> which might be undertaken should the property change hands• way <br /> n <br /> for the Town to approve the application for re-zoning without opening <br /> the doors to uses not presently proposed or desired is being sought. <br /> n_ <br /> The intention is to find a mechanism which will not interfere with <br /> the rehabilitation of the Tyrol Basin property. <br /> The CUP for the RE-I part of the property is only a <br /> documentation of• the agreement reached concerning the control of <br /> lighting on the ski slopes in order to minimize nuisances for the <br /> neighbors. <br /> The CUP for the proposed B-1 part of the property is to allow <br /> the operation of a tavern during the activities for which such a <br /> service would be beneficial to the owners of the business, and avoid <br /> the operation of a tavern at late hours or as a single function of <br /> Tyrol, or otherwise being a nuisance for the community. <br /> The question of adequate parking came up. Keeping people from <br /> parking on the roads could be attempted by posting and policing the <br /> roads when large crowds are present. <br />
