jurisdiction of zoning ordinances of Dane County at the time <br /> the enforcement action is commenced; and <br /> (b) Burke. The Town Government of the Town of Burke, <br /> Dane County, Wisconsin, provided that the Real Estate is <br /> within the governmental jurisdiction of the Town of Burke at <br /> the time the enforcement action is commenced; and <br /> (c) Other Owners. Each of the owners of the Lots. <br /> The Zoning Restrictions may be amended as herein provided. A <br /> written petition ("Amendment Petition") calling for an amendment to <br /> the Zoning Restrictions, executed by the owners of the Lots, shall <br /> be submitted to the Dane County Clerk who shall refer the petition <br /> to the Dane County Zoning and Natural Resources Committee (or <br /> successor committee) , which committee shall schedule and hold a <br /> public hearing on the petition in the same manner as public <br /> hearings for zoning amendment petitions are noticed and scheduled. <br /> Following such hearing, the committee shall issue an written report <br /> on the petition to the Dane County Board of Supervisors which <br /> shall, by majority vote, approve or reject the petition. If <br /> approved, the petitioners shall cause to be prepared the amendatory <br /> instrument, have the same executed by the owners of the Lots and <br /> recorded with the Dane County Register of Deeds. The proposed <br /> amendments to the Zoning Restrictions must be approved by the Town <br /> Board of the Town of Burke, or its successor. <br /> The Zoning Restrictions may be terminated as herein provided. <br /> In the same manner, and following the same procedures, as provided <br /> above for amending the Zoning Restrictions, the Zoning Restrictions <br /> may be terminated (except that the petition ("Termination <br /> Petition") shall call for termination of the Zoning Restrictions <br /> and, if approved by the Dane County Board of Supervisors and the <br /> Town Board of the Town of Burke (or its successor) , the instrument <br /> to be recorded shall be an instrument of termination) . <br /> All owners of the Lots hereby agree a that they shall execute an <br /> Y <br /> Amendment Petition or Termination Petition, as the case may be, if <br /> owners of not fewer than ten (10) Lots consent in writing to filing <br /> such Amendment Petition or Termination Petition, as the case may <br /> be, with the Dane County Clerk. Execution of an Amendment Petition <br /> (and related amendatory instrument) or Termination Petition (and <br /> related termination instrument) by not fewer than ten (10) Lots <br /> shall be deemed to be consented to and executed by all of the <br /> owners of the Lots. For as long as the Developer has title to or <br /> any interest in the Lots, or any of them, an Amendment Petition or <br /> Termination Petition may not be filed with the Dane County Clerk <br /> unless the Developer has consented in writing to such filing. <br /> 2 . Covenants. The ownership, use and development of the <br /> Lots, and construction of all improvements thereon from time to <br /> -3- <br />
