A positive vote by any of these has the <br /> effect of ratifying the filing of the petition and the owner of the property is then in the <br /> same position he or she would have been in had the petition been filed by any of these in <br /> the first place. <br /> There is one final element that must be considered, namely, whether in fact the <br /> non-owner filer is in the area to be affected by the amendment. This is a question of <br /> fact for the county zoning agency (your committee) to decide. Like all questions of <br /> fact, it must be decided on a case by case basis. In one case the owner of lands <br /> adjoining the subject property may not be in the area to be affected while in another <br /> case, the owner of lands located some distance away may be in the area to be affected. <br /> The decision is the Committee's, at least in the first instance, and the Committee could <br /> decide to dismiss the petition on the ground that the petitioner is not a property owner in <br /> the area to be affected by the petition. <br /> Sincerely, <br /> AP.
