• <br /> • <br /> • <br /> FORMAL REQUEST FOR APPEAL FROM ACTION <br /> BY DANE COUNTY ZONING COMMITTEE <br /> It is hereby requested that the action taken by the Dane County <br /> Agriculture, Environment and Land Records Committee with relation to the <br /> conditional use permit no. 462 applied for by Eugene Johnson for Lot 3, <br /> Hammersley Heights, located at 21 Nygard Street, Section 35, Town of <br /> Madison, be rescinded. This is a formal appeal from that decision, a <br /> copy of which is attached hereto as Exhibit A. <br /> This appeal is from the findings of the Committee, and is an appeal <br /> from each and every finding. <br /> Those findings apparently were that "all such standards of the <br /> ordinance will be complied with". <br /> The standards are as follows: <br /> a. That the establishment, maintenance or operation of the condi- <br /> tional use will not be detrimental to or endanger the public health, <br /> safety, comfort or general welfare. <br /> b. That the uses, values and enjoyment of other property in the <br /> neighborhood for purposes already permitted shall be in no foreseeable <br /> manner substantially impaired or diminished by establishment, maintenance <br /> or operation of the conditional use. <br /> c. That the establishment of the conditional use will not impede <br /> the normal and orderly development and improvement of the surrounding <br /> property for uses permitted in the district. <br /> d. That adequate utilities, access roads, drainage and other <br /> necessary site improvements have been or are being provided. <br /> e. That adequate measures have been or will be taken to provide <br /> ingress and egress so designed as to minimize traffic congestion in the <br /> public streets and <br /> f.
