N •. <br /> • <br /> S <br /> • <br /> Dane County Ag, Environmental and Land Recor Committee <br /> Dane County Regional Planning Commission Staff Comments 10-22-85 <br /> TLS:jes <br /> Conditional Use Permit #462 <br /> The proposed C.U.P. is within the urban service area of the Town of Madison. <br /> The Town of Madison Community Development Plan adopted by the town board <br /> on December 10, 1984 includes 32 development policies, but the plan does <br /> not address churches. Churches are considered compatible with single <br /> family homes, since both uses are allowed in the R-3 district. Because <br /> of the unique characteristics of certain uses allowed in the R-3 district; <br /> churches, day care centers, clubs and other are allowed only as conditional <br /> uses. The Dane County Zoning Ordinance incorporates six standards to <br /> evaluate the impact of churches upon neighboring residential properties: <br /> Conditional Use Standards [Sec. 10.255 (2)(g)] <br /> 1 . That the establishment, maintenance, or operation of the conditional <br /> use will not be detrimental to or endanger the public health, safety, <br /> comfort, or general welfare. <br /> Staff Comment: The establishment, maintenance or operation of a church <br /> would not in itself be detrimental to or endanger the public health, <br /> safety, comfort or general welfare. Churches are commonly located <br /> in single family residential areas. Absent any evidence of activities <br /> that would be detrimental , we believe the applicant meets standard 1 . <br /> 2. That the uses, values and enjoyment of other property in the neighbor- <br /> hood for purposes already permitted shall be in no foreseeable manner <br /> substantially impaired or diminished by establishment, maintenance <br /> or operation of the conditional use. <br /> 3. That the establishment of the conditional use will not impede the <br /> normal and orderly development and improvement of the surrounding <br /> property for uses permitted in the district. <br /> Staff Comment: We believe that conditions should be stipulated to <br /> meet these standards. The proposed use could impact the neighborhood <br /> with respect to parking, sound, stormwater runoff and perhaps visual <br /> appearance. The site plan submitted indicates that thought has been <br /> given to building_ and parking location in relation to existing trees <br /> on the property. Since the site is on a narrow street (50 ft. ROW) <br /> with no curb and gutter or sidewalk there is a concern for potential <br /> on-street parking. <br /> The parking area shown on the site plan complies with zoning ordinance <br /> requirements (1 parking space for each 7 seats). However, this <br /> requirement generally presupposes some on-street parking being <br /> available. A minimum standard would be 1 off-street parking space <br /> for each four seats.
