Under the statute, then Clinic Care must prove not only
that converting St . Joseph s into a Treatment Center is "con-
sistent with (or "not (in) conflict with") agricultural uses ,
but also that a Treatment Center at St . Joseph ' s is necessary--
that there are no better alternatives.
2. The Mandatory Standards. In addition to the
statutory requirements, Ord. , S 10. 255 (2) (g) establishes six
mandatory standards and provides that a conditional use permit
cannot be granted unless Clinic Care Corp . proves ,
and the Zoning Committee makes an affirmative finding , that each
of these six standards has been met. The standards are:
"1. That the establishment, maintenance, or oper-
ation of the Treatment Center will not be
detrimental to or endanger the public health,
safety, morals, comfort, or general welfare.
"2. That the uses, values and enjoyment of other
property in the neighborhood for purposes
already permitted shall be in no foreseeable
manner substantially impaired or diminished
by establishment, maintenance or operation
of the proposed Center .
"3. That the establishment of the Treatment Center
will not impede the normal and orderly devel-
opment and improvement of the surrounding
property for uses permitted in the district.
"4. That adequate utilities, access roads, drainage
and other necessary site improvements have been
or are being provided.
"5. That adequate measures have been or will be
taken to provide ingress and egress so de-
signed as to minimize traffic congestion in
the public streets.
-3-
