Under the statute, then Clinic Care must prove not only <br /> that converting St . Joseph s into a Treatment Center is "con- <br /> sistent with (or "not (in) conflict with") agricultural uses , <br /> but also that a Treatment Center at St . Joseph ' s is necessary-- <br /> that there are no better alternatives. <br /> 2. The Mandatory Standards. In addition to the <br /> statutory requirements, Ord. , S 10. 255 (2) (g) establishes six <br /> mandatory standards and provides that a conditional use permit <br /> cannot be granted unless Clinic Care Corp . proves , <br /> and the Zoning Committee makes an affirmative finding , that each <br /> of these six standards has been met. The standards are: <br /> "1. That the establishment, maintenance, or oper- <br /> ation of the Treatment Center will not be <br /> detrimental to or endanger the public health, <br /> safety, morals, comfort, or general welfare. <br /> "2. That the uses, values and enjoyment of other <br /> property in the neighborhood for purposes <br /> already permitted shall be in no foreseeable <br /> manner substantially impaired or diminished <br /> by establishment, maintenance or operation <br /> of the proposed Center . <br /> "3. That the establishment of the Treatment Center <br /> will not impede the normal and orderly devel- <br /> opment and improvement of the surrounding <br /> property for uses permitted in the district. <br /> "4. That adequate utilities, access roads, drainage <br /> and other necessary site improvements have been <br /> or are being provided. <br /> "5. That adequate measures have been or will be <br /> taken to provide ingress and egress so de- <br /> signed as to minimize traffic congestion in <br /> the public streets. <br /> -3- <br />
