Madison Area Headquarters 3070 Fish Hatchery Road Carroll D.Besadny Fitchburg, Wisconsin 53713 $,,,ray June 20, 1986 4410-2 Mr. John DeBeck Refuse'Hideaway Landfill 4808 Hwy. 12 Middleton, WI 53562 Dear Mr. DeBeck: Re: Notice of Noncompliance - Refuse Hideaway Landfill , License No. 1953 - Sedimentation Pond Enclosed are copies of the State Laboratory analyses of the April 28, 1986 water samples we took in your sedimentation pond and in the agricultural drainage ditch (which connects to the Black Earth Creek) south of the site. The analysis reveals substantial contamination by organic mate- rials of the pond water. The dissolved oxygen level measured in the ditch was also low indicating that the runoff from the pond is probably impacting the ditch. In view of the relatively close proximity of the pond, with an overflow pipe, to the ditch, it is the opinion of our staff that the contaminated pond water does reach the ditch during periods of precipitation and runoff. During our visit Warden Kuzma evaluated • the surface water connections and determined that the ditch does connect with the Black Earth Creek. The contaminated water is, therefore, entering surface "waters of the state." Discharge of this water into surface waters is a violation of NR 180.13(10)(b)2. ' The Department is, by this Notice, directing you to take remedial action to eliminate the source of contamination reaching the sedimention pond. I believe the source to be leachate seeps within the interior of the landfill site which are contaminating the runoff water. A letter describing what action you have taken to correct this problem should be submitted within 30 days of the date of this letter.
