The dissolved oxygen level measured in <br /> the ditch was also low indicating that the runoff from the pond is <br /> probably impacting the ditch. <br /> In view of the relatively close proximity of the pond, with an <br /> overflow pipe, to the ditch, it is the opinion of our staff that <br /> the contaminated pond water does reach the ditch during periods of <br /> precipitation and runoff. During our visit Warden Kuzma evaluated • <br /> the surface water connections and determined that the ditch does <br /> connect with the Black Earth Creek. The contaminated water is, <br /> therefore, entering surface "waters of the state." Discharge of <br /> this water into surface waters is a violation of <br /> NR 180.13(10)(b)2. ' <br /> The Department is, by this Notice, directing you to take remedial <br /> action to eliminate the source of contamination reaching the <br /> sedimention pond. I believe the source to be leachate seeps <br /> within the interior of the landfill site which are contaminating <br /> the runoff water. <br /> A letter describing what action you have taken to correct this <br /> problem should be submitted within 30 days of the date of this <br /> letter. <br />
