Variance 3548 was granted for this lot and project in the Shoreland <br /> district on 08/28/2008, with the Condition "as requested by the Town of Dunn to keep surface water runoff <br /> generated on this property from going onto the adjacent properties" (see Minutes with packet on your desk). The <br /> Minutes also included a "Staff Note: Schutte or Lane will review the plans to verify compliance with the Zoning <br /> Ordinance, including maximum 30% lot coverage and minimum setback from OHWM, to assure satisfaction of <br /> Variance Condition before a Zoning Permit may be issued." <br /> I talked with Wohlferd a few weeks ago about the permitting process, gave him a copy of the Minutes, and asked <br /> him to provide me with all the documents for review, including a copy of the site plan for the Shoreland Erosion <br /> Control Permit. I use this to verify what's happening to runoff toward the neighbors' lots when the Town of Dunn <br /> asks for the above condition and the BOA includes it in the variance approval. <br /> Since I'll be gone until 01/05, I need to ask you and Scott to complete the necessary review, please, and issue the <br /> Zoning Permit if you believe the Condition has been met. Upon a very cursory review today, it seems the <br /> setbacks and lot coverage are OK. However, I have a question about how runoff is being controlled toward the <br /> south. <br /> Wohlferd argues that only new runoff should be "controlled." Ben at the Town of Dunn (with whom I have not <br /> communicated before re: the variance appeal or permit application) seems to echo that. However, it's been my <br /> experience that the Town of Dunn's Condition is intended to avert any changes to the runoff for neighbors of <br /> newly-developed lots. I'm not sure it's possible to quantify what part of the runoff was pre-existing and what part <br /> is new, so I have always looked for a berm or well-defined swale along the entire down-slope property line, as <br /> shown on a topo map. <br /> See the 12/18 email from Jason Tuggle at LCD regarding the same issue. The 12/18 response from Calkins <br /> Engineering indicates a "revised plan" was attached. However, the only Calkins"Proposed Grading Plan" that <br /> Wohlferd submitted today is dated 12-09-08 (no revision date). Wohlferd said there might be a "revised" site plan <br /> at Land Conservation, but didn't supply one. <br /> The 12/08 plan appears to me to show runoff toward the south to the west side of the garage on the neighboring <br /> property. In my opinion, that could 'funnel' part of the runoff from the new house directly toward the small house <br /> on the neighboring lot. For more information about pre-existing conditions (there is a smaller house at 2891 Bible <br /> camp Road now), please see the documentation in the Variance 3538 file. <br /> Do you think the grading plan as submitted will prevent runoff from adversely affecting the neighbor to the south? <br /> I don't think the decision should wait until I come back, so I'll be satisfied with whatever decision you make. <br /> Please contact Wohlferd directly.
