No objections were raised." <br /> 09/23/2008 Email from John Hausbeck, Supervisor, City/County Public Health with attachment from <br /> Martin Nessman, Water Supply Specialist, WDNR, explaining that the proposed location of the <br /> existing well in a proposed rain garden did not meet state regulations; email was read into the record. <br /> 09/24/2008 Email from Temple regarding proposed relocation of the existing well at least 100 feet <br /> from the proposed rain garden, in compliance with state regulations; email was read into the record. <br /> 09/24/2008 Letter from Cami Peterson, Water Regulation and Zoning Specialist, WDNR, <br /> recommending denial of the variances; letter was read into the record. <br /> VARIANCES REQUESTED: Purpose: Allow construction of a new single-family residence on <br /> an existing, substandard, platted lot in the Shoreland district <br /> Lot Area Variance: <br /> Minimum lot area required: 15,000 SF for sewered Shoreland lot. <br /> Actual lot area: 8,377 SF. <br /> VARIANCE NEEDED: 6,623 SF <br /> Lot Width Variance <br /> Minimum lot width at building setback line required: 100 feet. <br /> Actual lot width: 60.00 as platted, 59.97 feet as surveyed at building setback line. <br /> VARIANCE NEEDED: 40.00 feet as platted, 40.03 feet as surveyed <br /> IN FAVOR: Terry Temple, Temple Construction, Inc., Madison, WI -- designer and contractor <br /> Jerry Rekowski, Stoughton, WI — owner, was "available for information only" <br /> OPPOSED: None <br /> ZONING ADMINSTRATOR'S RECOMMENDATION: No recommendation from Zoning Administrator <br /> Roger Lane, as reported by Assistant Zoning Administrator Schutte. <br /> Motion: Hamre/Studz to grant a variance of 6,623 square feet (SF) from minimum required 15,000 <br /> SF lot area, and a variance of 40.00 feet as platted, 40.03 feet as surveyed from the 100 feet <br /> minimum required lot width at the building setback line, to allow construction of a new single-family <br /> residence on an existing, substandard, platted lot in the Shoreland district, with the Condition <br /> requested by the Town of Dunn: "[I]nstalling a rain garden and keeping the surface runoff generated <br /> on this property from going onto the adjacent properties." <br /> Finding of Fact: <br /> 1. Vacant lot in Colladay's Point Subdivision was platted in 1939, and is in the R-3 Residential zoning <br /> district and Shoreland district of Lake Kegonsa. Permits were issued for a new house on this lot <br /> 1978 and again in 1980, but both expired, and no house was built. <br /> 2. The lot area measured to "water's edge" at time of survey (08/05/08) was 8,377 SF (The <br /> Ordinary High Water Mark (OHWM) of 843.5 was not determined at that time, due to the high <br /> water level.) The lot width at building setback line is 60 feet platted, 59.97 feet as surveyed. The <br /> averaged setback from (Ordinary High Water Mark) OHWM is 52 feet as per survey and as <br /> verified by research into Zoning Division records. . <br /> 3. The owner proposes to build a new two-story, single-family residence with a walkout lake-front <br /> lower level, including lower level usable space beneath the attached garage. Temple provided <br /> updated plans and elevations for the Board's review. Proposed plans show no encroachment into <br /> any setbacks, and compliance with maximum 30% lot coverage and maximum height restrictions. <br /> 4. Temple described site development: Well relocation and landscaping features (rain garden, new <br /> rip-rap bank, complying maximum 30-foot viewing corridor) will reduce run-off and comply with <br /> Dane County and WDNR regulations. The site plan respects existing sanitary sewer lateral and <br /> grinder pump easements. <br />
