That the University of Wisconsin is located in the City of Madison, <br /> Dane County, Wisconsin. <br /> 2. That the aforementioned institution operates a waste chemical burning <br /> site located in the Town of Westport, Dane County, and that this waste <br /> chemical burning site is an existing source. <br /> 3. That the Department has determined that the University of Wisconsin <br /> is open burning waste chemicals in the Town of Westport, Dane County. <br /> 4. That the University of Wisconsin has constructed at their Arlington <br /> Farms property a solvent incinerator which has been approved for use by <br /> the Department. <br /> 5. That no approved county air pollution control program exists for <br /> Dane County. <br /> Conclusions of Law <br /> 1. That the Department of natural Resources is authorized by Section <br /> 144.31, Wisconsin Statutes, to promulgate rules implementing and consistent <br /> wth as 144.30 to 144.46. <br /> 2. That ?,R2 154.10, Wisconsin Administrative Code. prohibits the open <br /> burning of chemical wastes for which there are other safe methods of <br /> disposal. <br /> 3. That the Department of Natural Resources has authority under as <br /> 144.31(2)(b) and 144.35, Wisconsin Statutes, to issue a special order to <br /> abate the discharge of air conta!ninants to the atmosphere of the state <br /> of Wisconsin. <br /> F!� <br /> ` F <br />
