Please include this email and that of Oct 10 along with the attached petition signed by <br /> members of the APHOA in the packets and file that the ZLR members receive. <br /> As you know, Mr. Spahn is seeking a Conditional Use Permit(CUP)for UNLIMITED animals on the 7 acres which is Lot <br /> 31. I did in fact meet with Mr.Spahn two years ago on Lot 31 to discuss the issues that led to the complaint and I was <br /> rebuffed. In a follow-up letter year or so later in which I requested a response, I received none. It was only after <br /> contacting the county was any action taken,that being the CUP request. <br /> I do not believe we are creating a hardship for Mr. Spahn or being un-neighborly. In fact, quite the opposite is true. As <br /> the owner of Lot 31, a lot within the plat of Autumn Pond,the Spahns are our neighbors and yet they have made no <br /> attempt to maintain or provide even the provide most basic upkeep to the property, including the pasture or <br /> outbuildings. Mr.Spahn has invested the proceeds from the sale of the Autumn Pond property north of Enchanted <br /> Valley Road and acquired two farms, one in the Town of Springfield and the other in the Town of Black Earth. These are <br /> in addition to his main operation located on CTH K in the Town of Springfield. The Spahns most definitely own enough <br /> property to house and maintain these cattle elsewhere. Please see attached. <br /> As you may know,the Spahns originally agreed to allow Lot 31 and the 80 acres south of Enchanted Valley Road to <br /> develop as part the Autumn Pond neighborhood. They have since changed their minds but this does not change the fact <br /> that we have all invested in Autumn Pond based on the zoning that was approved by the town and county at the time <br /> the neighborhood was platted. The approval process itself took almost four years and at the time, I was representing <br /> the Spahn family as the developer of Autumn Pond. The Spahns signed the plat. Approving the CUP will have negative <br /> and long term ramifications for the Autumn Pond neighborhood. <br /> I respect the Spahns as famers and longtime landowners in the Town of Springfield but if there was ever a instance <br /> where the old adage"Having your cake and eating it too" applies, this would be it. <br /> I copied you and Shawn Widish on a similar email of Oct 3 requesting this correspondence be filed and provided to <br /> members of ZLR committee,which meets tonight to consider the CUP request. <br /> 1 <br />
