With regards to agreements with Spahn,the contract I had with Spahn that was in affect at the time of first closing in <br /> Oct of 2007 mirrored the restrictions put on us by the town, which limited development of the farm to four phases,one <br /> phase every three years. This would have required me to close on the land making up the 2"d phase in 2010 during the <br /> heart of the recession and at which time I still had the majority of the 14 lots from the 1st phase unsold. As I was still <br /> making interest only payments to the State Bank of Cross Plains and paying 4%to Spahn on his note, I was not able to <br /> close on Phase II and Spahn agreed to cancel the contract. With regards to Lot 31,the original contract gave me the <br /> ability to acquire Lot 31 when the last lot was sold from the last phase. Had it not been for the recession, I suppose that <br /> could have been about now. <br /> I've copied Mike Lawton here, only in case he remembers something differently. <br /> I was ultimately able to reach an agreement with Spahn in 2013 and 2014 for the land that is now Phase II and Phase III <br /> and includes OL3 (pond and surrounding acreage),which was acquired as part of Phase III.
