° ��, Dane County Planning & Development <br /> I; <br /> i ,�- (of ,/ Division of Zoning <br /> December 12,2016 <br /> Harold Spahn <br /> 4996 Enchanted Valley Road <br /> Middleton,WI 53562 <br /> Re: Violation occurring at 4996 Enchanted Valley Road,Middleton,WI 53562 <br /> Parcel#0808-312-0032-0 <br /> Dear Mr. Spahn, <br /> Since July 2016 we have been working together towards compliance with regards to the violation on your property <br /> identified above of`exceeding the number of livestock allowed on your property'.The current zoning district for the <br /> property at 4996 Enchanted Valley Road is A-2(4).According to Dane County Code of Ordinance No. <br /> 10.126(5)(b)2."On parcels sized between 2 acres through 16 acres the keeping of livestock shall be limited to 1 <br /> animal unit per each full acre."The property at 4996 Enchanted Valley Road is shown as 7.454 acres per Lot 1, <br /> Certified Survey Map No. 13995. <br /> On August 18,2016 you applied for Conditional Use Permit number 02360 for unlimited livestock on 3 - 16 acres. <br /> The original public hearing was scheduled for October 25,2016,however the committee postponed action on the <br /> petition due to no town action.The work meeting is scheduled for tomorrow December 13,2016. <br /> On December 5th,2016,Joe Spahn requested to withdraw the CUP petition.A site inspection was conducted with <br /> Joe in attendance and was documented that there were 56 head of cattle onsite.Joe declined to document his request <br /> to withdraw the CUP stating he wanted to keep his options. <br /> Should you or an agent on your behalf not attend the work meeting tomorrow evening and/or should the CUP be <br /> denied this letter is serving as notice that your property at 4996 Enchanted Valley Road is in violation of the <br /> ordinance.Exceeding the keeping of 7 animal units is not permitted in your zoning district of A-2(4). <br /> You are hereby instructed to either remove those units over the limit of 7.
